 PROVIDING FOR CONSIDERATION OF THE BILL (S. 352) TO POSTPONE THE DTV 
                            TRANSITION DATE

   Mr. Cardoza, from the Committee on Rules, submitted the following

                       [To accompany H. Res. 108]

    The Committee on Rules, having had under consideration 
House Resolution 108, by a nonrecord vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of S. 352, the 
``DTV Delay Act,'' under a closed rule. The resolution provides 
for one hour of debate equally divided and controlled by the 
chair and ranking minority member of the Committee on Energy 
and Commerce.
    The resolution waives all points of order against 
consideration of the bill except those arising under clause 10 
of rule XXI. The bill shall be considered as read. The 
resolution waives all points of order against the bill. The 
resolution provides one motion to commit the bill with or 
without instructions.
    Finally, the rule amends section 2 of H. Res. 92 to provide 
that the chair of the Committee on Appropriations shall insert 
in the Congressional Record no later than February 26, 2009, 
such material as he may deem explanatory of appropriations 
measures for fiscal year 2009.

                         EXPLANATION OF WAIVERS

    Although the rule waives all points of order against 
consideration of the bill (except for those arising under 
clause 10 of rule XXI), the Committee is not aware of any

would authorize $250 million for the converter box coupon 
program. It also extends the FCC's spectrum auction authority 
to 2012.

    Summary of motion: To make in order and provide appropriate 
waivers for an amendment by Rep. Walden, Greg (OR), #2, which 
would provide that the FCC has no discretion to prevent a 
broadcaster from transitioning voluntarily before the deadline 
as long as they will not cause interference with public safety 
or other stations. The station must have given viewers 30 days 
notice prior to the cutoff.
