              SEPTEMBER 30, 2011, AND FOR OTHER PURPOSES.

    Mr. Arcuri, from the Committee on Rules, submitted the following

                      [To accompany H. Res. 1569]

    The Committee on Rules, having had under consideration 
House Resolution 1569, by a record vote of 7 to 3, report the 
same to the House with the recommendation that the resolution 
be adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 5850, the 
``Transportation, Housing and Urban Development, and Related 
Agencies Appropriations Act, 2011,'' under a structured rule. 
The resolution provides one hour of general debate equally 
divided and controlled by the chair and ranking minority member 
of the Committee on Appropriations. The resolution waives all 
points of order against consideration of the bill except those 
arising under clause 9 or 10 of rule XXI. The resolution 
provides that the bill shall be considered as read through page 
171, line 17. The resolution waives points of order against 
provisions in the bill for failure to comply with clause 2 of 
rule XXI. The resolution makes in order the following 
amendments: (1) the amendments printed in part A of this 
report; and (2) not to exceed four of the amendments printed in 
part B of this report if offered by Representative Flake of 
Arizona or his designee. The resolution provides that each such 
amendment may be offered only in the order printed in this 
report, may be offered only by a Member designated in this 
report, shall be considered as read, shall be debatable for 10 
minutes equally divided and controlled by the proponent and an 
opponent, and shall not be subject to a demand for division of 
the question. All points of order against the amendments except 
for clauses 9 and 10 of rule XXI are waived. The resolution 
provides that for those amendments reported from the Committee 
of the Whole, the question of their adoption shall be put to 
the House en gros and without division of the question. The 
resolution provides one motion to recommit with or without 
instructions. The resolution provides that after disposition of 
the amendments specified in the first section of the 
resolution, the chair and ranking minority member of the 
Committee on Appropriations or their designees each may offer 
one pro forma amendment to the bill for the purpose of debate, 
which shall be controlled by the proponent. The resolution 
provides that the Chair may entertain a motion that the 
Committee rise only if offered by the chair of the Committee on 
Appropriations or his designee. Finally, the resolution 
provides that the Chair may not entertain a motion to strike 
out the enacting words of the bill.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the bill (except for clauses 9 and 10 of rule XXI) includes a 
waiver of clause 4(c) of rule XIII, requiring the three-day 
availability of printed hearings on a general appropriations 
bill; and a waiver of Section 306 of the Congressional Budget 
Act, prohibiting consideration of legislation within the 
jurisdiction of the Committee on the Budget unless reported by, 
or discharged from, the Budget Committee. The waiver of all 
points of order against provisions in the bill includes a 
waiver of clause 2 of rule XXI, prohibiting unauthorized 
appropriations or legislative provisions in an appropriations 
bill.

    9. DeFazio (OR): Would prohibit any funds under the Act 
from being used to reallocate Federal highway formula funding 
for the livable communities program unless the program is first 
authorized by Congress. (10 minutes)
    10. Culberson (TX): Would reduce the bill's funding level 
by $12.4 billion dollars, returning the bill to the FY2009 
funding level. This is an 18% cut in the bill's spending. (10 
minutes)
    11. Johnson, Eddie Bernice (TX): Would increase by $10 
million activities under Section 107, under the Community 
Development Grant program at HUD. Specifically additional 
funding would be requested for the HBCU Community Development 
Grant Program. Subsequently, reverse mortgages would be 
decreased by $10 million. (10 minutes)
    12. Graves (MO): Would prohibit the Federal Aviation 
Administration from using funds in the Act to require a sponsor 
of a public general aviation airport to terminate existing 
residential through-the-fence agreements. or otherwise withhold 
funds from a sponsor of a general aviation airport, solely 
because the sponsor enters into a residential through-the-fence 
agreement. (10 minutes)
    13. Moore, Gwen (WI): Would increase funding for the Office 
of Small and Disadvantaged Business Utilization by $100,000 and 
increase funding for the Minority Business Research Center's 
outreach activities by $225,000 to help ensure that the small 
and disadvantaged business policies and goals of the Department 
are developed and implemented. (10 minutes)
    14. Neugebauer (TX): Would reduce spending in the bill by 
$10.52 billion. This amount represents the uncommitted funds 
from the $61.7 billion in 2009 stimulus funds that were 
appropriated for transportation and housing related program. 
(10 minutes)
    15. Braley (IA): Would increase funding to the Community 
Development Block Grant (CDBG) by $20 million and would offset 
this increase with a decrease of $20 million for non-personnel 
expenses within the Department of Housing and Urban 
Development. The purpose of the CDBG funding increase is to 
provide CDBG disaster relief and recovery funds to assist 
communities in the Midwest affected by the flooding that 
occurred during July of 2010. (10 minutes)
    16. Turner (OH): Would prevent funds in the bill from being 
used to prohibit the establishment of any occupancy preference 
for veterans in supporting housing for the elderly that is 
assistance by HUD and is located on Department of Veterans 
Affairs (VA) property or is subject to an enhanced use lease 
with the VA. (10 minutes)
    17. Kirkpatrick (AZ): Would make an across the board cut of 
5% from the base text of the bill. It would reduce the cost of 
the bill by $3.37 billion, bringing the total cost of the bill 
down to $64.03 billion. (10 minutes)
    18. Jordan (OH): Would reduce spending by $18,579,000,000 
in order to reflect FY 2008 levels. (10 minutes)
    19. Peters (MI), Adler (NJ), Himes (CT), Welch (VT): Would 
strike or reduce funding for a number of programs funded above 
the President's request. Programs included: high speed rail, 
TIGER grants, HOPE VI, Brownfields Redevelopment, Railroad 
Safety Technology Program, HUD-VASH, Resident Opportunity and 
Supportive Services, Section 108 Loan Guaranties, Self-help 
Homeownership Opportunity Program, and the HOME Program. (10 
minutes)
    20. Bachmann (MN): Would reduce funding for Capital and 
Debt Service Grants to the National Railroad Passenger 
Corporation for capital investments by $1,203,500,000. (10 
minutes)

Corridor project in the City of Durham, North Carolina and 
reduce the overall cost of the bill by the same amount.

made available for the planning and design of a library for 
City of Mount Rainier, Maryland and reduce the overall cost of 
the bill by the same amount.

park in the City of Winter Park, Florida and reduce the overall
