Long Hansen's Disease Center to the National Hansen's Disease Programs Center. Background and Need for Legislation In the 105th Congress, legislation was passed which transferred ownership of the Gillis W. Long Hansen's Disease Center in Carville, Louisiana, from the U.S. Department of Health and Human Services to the State of Louisiana. The legislation was prompted by the need to downsize the federal government's occupancy from the excessively large facility in Carville to a more manageable location in Baton Rouge. Currently, the Carville campus is occupied by the Louisiana National Guard's Youth Challenge Program. The National Hansen's Disease Programs (NHDP) are now housed at Summit Hospital in East Baton Rouge Parish. Prior to this legislation, the National Hansen's Disease Programs were physically located in the Gillis W. Long Hansen's Disease Centerin Carville. After this legislation became law, the NHDP moved to its present home at Summit Hospital. Though the programs have moved from Carville to Baton Rouge, they still bear the name ``Gillis W. Long Hansen's Disease Center.'' Likewise, the campus in Carville now occupied by the Louisiana National Guard is named the Gillis W. Long Center. The consequences of these circumstances are frustrating and burdensome, and create unnecessary postal delays. Mail directed to the NHDP, including legal and research documents and vital patient information, go to Carville rather than Baton Rouge because the facilities share the same name. Current Federal law requires the location of the NHDP to be named Gillis W. Long Hansen's Disease Center; therefore only legislation can correct it. H.R. 2441 changes the name of the NHDP. Hearings There have been no hearings held on H.R. 2441 in the 107th Congress. Committee Consideration On Wednesday, July 11, 2001, the Subcommittee on Health met in open markup session and approved H.R. 2441 for Full Committee consideration, by a voice vote, a quorum being present. On Wednesday, July 18, 2001, the Full Committee met in open markup session and ordered H.R. 2441 favorably reported to the House by unanimous consent, a quorum being present. Committee Votes Clause 3(b) of rule XIII of the Rules of the House of Representatives requires the Committee to list the record votes on the motion to report legislation and amendments thereto. There were no record votes taken in connection with ordering H.R. 2441 reported. A motion by Mr. Tauzin to order H.R. 2441 reported to the House was agreed to by unanimous consent. Committee Oversight Findings Pursuant to clause 3(c)(1) of rule XIII of the Rules of the House of Representatives, the Committee held a legislative hearing and made findings that are reflected in this report. Statement of General Performance Goals and Objectives The goal of H.R. 2441 is to provide assistance in changing the name of the Gillis W. Long Hansen's Disease Center to the National Hansen's Disease Programs Center. New Budget Authority, Entitlement Authority, and Tax Expenditures In compliance with clause 3(c)(2) of rule XIII of the Rules of the House of Representatives, the Committee finds that H.R. 2441, a bill to amend the Public Health Service Act to redesignate a facility as the National Hansen's Disease Programs Center, and for other purposes, would result in no new or increased budget authority, entitlement authority, or tax expenditures or revenues. Committee Cost Estimate The Committee adopts as its own the cost estimate prepared by the Director of the Congressional Budget Office pursuant to section 402 of the Congressional Budget Act of 1974. H.R. 2441--A bill to amend the Public Health Service Act to redesignate a facility as the National Hansen's Disease Programs Center, and for other purposes H.R. 2441, would rename the Gillis W. Long Hansen's Disease Center the National Hansen's Disease Programs Center. CBO estimates that passage of H.R. 2441 would have no significant impact on the federal budget. The bill would not affect direct spending or receipts, and thus, is not subject to pay-as-you-go procedures. H.R. 2441 contains no intergovernmental or private- sector mandates as defined in the Unfunded Mandates Reform Act and would not affect the budgets of state, local, or tribal governments. Constitutional Authority Statement Pursuant to clause 3(d)(1) of rule XIII of the Rules of the House of Representatives, the Committee finds that the Constitutional authority for this legislation is provided in Article I, section 8, clause 3, which grants Congress the power to regulate commerce with foreign nations, among the several States, and with the Indian tribes. Applicability to Legislative Branch The Committee finds that the legislation does not relate to the terms and conditions of employment or access to public services or accommodations within the meaning of section 102(b)(3) of the Congressional Accountability Act. Section-by-Section Analysis of the Legislation Section 1. Designation of National Hansen's Disease Programs Center Section 1 amends section 320(a)(1) of the Public Health Service Act (42 U.S.C. 247e(a)(1)) by striking ``Gillis W. Long Hansen's Disease Center'' and inserting ``National Hansen's Disease Programs Center.'' Any reference in a law, map, regulation, document, paper, or other record of the United States to the Gillis W. Long Hansen's Disease Center shall be deemed to be a reference to the National Hansen's Disease Programs Center. (a)(1) At or through the [Gillis W. Long Hansen's Disease Center] National Hansen's Disease Programs Center (located in the State of Louisiana), the Secretary shall without charge provide short-term care and treatment, including outpatient care, for Hansen's disease and related complications to any person determined by the Secretary to be in need of such care and treatment. The Secretary may not at or through such Center provide long-term care for any such disease or complication. * * * * * * *
