Dear Mr. Speaker: In furtherance of the provisions of Public Law 107-38, the Emergency Supplemental Appropriations Act for Recovery from and Response to Terrorist Attacks on the United States, FY 2001, today I am notifying the Congress of my intent to reallocate funds previously transferred from the Emergency Response Fund. These reallocations reflect revised requirements in light of changing security needs in the wake of the terrorist attacks of September 11, 2001. As provided in Public Law 107-38, $325.0 million will be made available 15 days from the date of this transmittal to the Transportation Security Administration for civil aviation security and $1.7 million will be made available immediately for International Assistance Programs. The details of these actions are set forth in the enclosed letter from the Director of the Office of Management and Budget. I concur with his comments and recommendations. Sincerely, George W. Bush. The President, The White House: Submitted for your consideration are requests to revise the allocation of certain funds provided in P.L. 107-38, the Emergency Supplemental Appropriations Act for Recovery from and Response to Terrorist Attacks on the United States, FY 2001. These requests would reallocate funds previously transferred from the Emergency Response Fund (ERF) to the Department of Transportation and International Assistance Programs. The Administration now proposes that the Federal Aviation Administration (FAA) transfer a portion of the emergency response funds it received to the Transportation Security Administration (TSA) to support TSA pending enactment of FY 2002 supplemental funding, which you requested on March 21st. Specifically, you transferred $448.5 million to FAA in two increments--on October 22nd and November 9th. The current request would transfer $325.0 million of these funds to TSA temporarily for civil aviation security activities, to be available 15 days after the transmittal of this request. Further, and as part of this request, TSA would transfer these funds back to FAA upon the enactment of supplemental funding for TSA by Congress. In addition, your September 21st request to Congress transferred $2.4 million to the Agency for International Development (USAID), of which $2.0 million was to assist in the potential evacuation of USAID staff from missions overseas. However, fewer than expected evacuations were necessary, and therefore, of the amount originally transferred, $1.7 million is no longer needed for this purpose. We now propose that these funds be used to set up a mission in Afghanistan to fulfill the U.S. commitment to assist with the rebuilding of that nation. Pursuant to P.L. 107-38, this funding would be available immediately. I have carefully reviewed these proposals and am satisfied that they are necessary at this time.
