    Dear Mr. Speaker: In order to continue the investigation 
into the September 11, 2001, terrorist attacks on the United 
States, I am notifying the Congress of my intent to reallocate 
funds previously transferred from the Emergency Response Fund 
(ERF).
    At this time, $9 million of ERF funds will be transferred 
to the National Commission on Terrorist Attacks upon the United 
States to ensure that it has the necessary resources to 
investigate fully the terrible tragedy of September 11, 2001. 
My Administration is strongly committed to the purpose and 
mission of the Commission and will continue to cooperate with 
the Commission in accordance with applicable law to help ensure 
that it succeeds. I expect that the Commission's final report 
will contain important recommendations.
    The details of this action are set forth in the enclosed 
letter from the Director of the Office of Management and 
Budget. I concur with his comments and recommendations.

    Submitted for your consideration is a request to reallocate 
funds provided in P.L. 107-38, the Emergency Supplemental 
Appropriations Act for Recovery from and Response to Terrorist 
Attacks on the United States, FY 2001. This request would 
reallocate funds previously transferred from the Emergency 
Response Fund (ERF).
    In order to ensure that the National Commission on 
Terrorist Attacks upon the United States has sufficient 
resources to complete its mission, the Administration now 
proposes to reallocate $9 million in ERF funding previously 
transferred to the Small Business Administration (SBA) to the 
Commission. The SBA funds are available for transfer because 
they are in excess of identified disaster loan needs related to 
the September 11, 2001, terrorist attacks.
    The Commission was established in the Legislative Branch on 
November 27, 2002, to examine and report facts and causes 
related to the September 11th attacks, to report its findings 
to the Congress and the President, and to provide 
recommendations. This funding will be used to support the 
Commission's continuing investigation into the circumstances 
and causes of the terrorist attacks. Pursuant to P.L. 107-38, 
these funds will be made available immediately after this 
designation is forwarded to the Congress.
    I have carefully reviewed this proposal and am satisfied 
that it is necessary at this time. Therefore, I recommend your 
approval of the requested reallocation.

 Reallocation of Amounts Previously Appropriated and Transferred From 
                      the Emergency Response Fund

    These funds will be used, consistent with Title VI of 
Public Law 107-306, to examine and report facts and causes 
related to the September 11, 2001, terrorist attacks, to report 
to the President and the Congress on the Commission's findings, 
and to provide recommendations to prevent future attacks. 
Pursuant to Title VI, the Commission's findings are due no 
later than May 27, 2004 and the Commission terminates 60 days 
thereafter.
