Abstract: Extract: Issues are raised as to the consequences of increased reliance on private investment to develop new plants and mirco-organisms. Variable, evolving, and complex living things present a problem in applying patent laws which may not be able to provide the exclusive property rights necessary to recover private investments. Attempts to provide exclusivity may inadvertantly create added costs and affect the choice of breeding method and agricultural technologies, as well as the division of productivity gains between inventors and the public.

Abstract: Patents influence economic development and international competition in the biotechnology industry. They have been, and currently are, used in many countries as a form of non-tariff trade barrier, where legislative, judicial or simply policy mechanics dissuade non-residents from entering into business. Patent policies towards biotechnology are even more complicated than in other areas. Different definitions of patentable material and the lack of global standards have resulted in a diversity of national biotechnology patent policies. In order for biotechnology to mature as a global industry, these issues of patent nationalism and patent policy must be addressed by governments and the business and legal communities.

Abstract: For more than 100 years, inventors have been able to obtain patents for their innovations. It soon became obvious that patents were not adjusted to biological material such as plant varieties. Therefore a specific form of industrial property rights was created. This was done through the International Covention for the Protection of New Varieties of Plants. Under this Convention, plant breeders' rights may be granted for varieties including subtropical and tropical fruit crops. The criteria for granting a right and the scope of protection are described. All states parties to the Convention constitute the Union for the Protection of New Plant Varieties (UPOV). At present 19 states, including the Republic of South Africa, are members of UPOV. The cooperation of the member states in technical and legal aspects is outlined. It is explained how UPOV has started to adjust the Convention to the new developments in bio- and genetechnology.
