The National Environmental Policy Act (NEPA) was passed by Congress to foster better decision-making by officials. Its mandate is to insure information is available and considered before decisions and actions are implemented. The established process is quite straight forward.

 

Identify a Need

Make a Proposal

Inform the Public

Identify Concerns

Develop Alternatives

Prepare an EA or EIS

Public Review of Analysis

Make a Decision

 

 

 

TERMS USED

 

 Knowing the "NEPA language" is the first step in understanding this process. The following is a short list of common terms used to describe NEPA activities.

 

Alternatives - Once the issues surrounding a proposal are clear, alternatives are developed to achieve the project and respond to issues identified. All of the alternatives may not address all issues equally, but we strive to address all issues within the array of alternatives considered in detailed.

 

Categorical Exclusion - The level of analysis used for projects falling into one of several categories, for which neither an Environmental Impact Statement nor an Environmental Assessment is required.

 

Environmental Assessment (EA) - The environmental document prepared when we believe a project will not have significant environmental effects.

 

Environmental Impact Statement (EIS) - The environmental document prepared when we suspect a project may have significant effects. DEIS is the draft, FEIS is the final. 

 

Scoping - Informing the public of a proposal and soliciting public participation specific to that proposal. Usually assigned a certain time frame, but comments are often acknowledged after the "deadline."


Section 1 - Forest Plan Revisions and Amendments

 

In response to the National Forest Management Act direction and public/agency management needs, the Uinta and Wasatch-Cache National Forests are revising their individual Forest Plans. Specifics for each Forest are outlined below:

In 1997, we began work in preparation for the Forest Plan revision.  A Preliminary Assessment of the Management Situation was released for public review and comment on September 30, 1999. This included an assessment of the current conditions on the Forest and information about what we will be addressing in the forest plan revision. With publication of the Notice of Intent on September 30, 1999, the Forest initiated scoping for revision of the Forest Plan. Four public meetings to discuss the revision were held in October and November. The Forest received over 300 comments during this period. Two additional public workshops were held in March and April of 2000 to verify issues and provide opportunities for the pubic to review and comment on the preliminary drafts of the alternatives. As a result of these meetings, three additional alternatives were developed, increasing the number of alternatives analyzed in detail to six. These alternatives were analyzed, and documented in the Draft EIS, which was released for public review and comment, along with the Draft Revised Forest Plan, on May 4, 2001. The Draft EIS and Draft Revised Forest Plan identified two preferred alternatives.  Four open houses for this project were held in June, and one in August of 2001.  The initial 90-day public comment period on the Draft EIS and Draft Revised Forest Plan was extended.  The public comment period was scheduled to end August 2, 2001, but subsequently extended until October 1, 2001.  We received nearly 1,200 comments on the Draft EIS and Draft Revised Forest Plan.  A preliminary analysis of the comments was completed in April 2002.  A Final EIS, Revised Forest Plan and Record of Decision are tentatively scheduled for release in the winter of 2002. The Notice of Intent was published in September 1999 and formally began the revision analysis process. Public meetings to discuss the revision were held in October and November of 1999. The Forest developed six alternatives based on public input. A Draft EIS and Proposed Forest Plan were released for public review and comment on May 9, 2001. In June a series of seven public open houses to explain the Proposed Plan were held in communities near the forest. Oral Comment Forums were held in Logan on October 11, Salt Lake City on October 16 and Evanston, Wyoming on October 17. The public comment period ended November 1, 2001. Nearly 3,600 responses were received.  An Executive Summary of the content analysis has been posted on our website.  A newsletter was sent to interested parties in late June, 2002. The Planning Team is working on responding to public concerns and finalizing the EIS and Forest Plan.  A Final EIS, Revised Forest Plan and Record of Decision are tentatively scheduled for release in January of 2003. Status and Comments:  Scoping has been completed for each of the projects except the Bjorkman Water Development. Scoping for Bjorkman Water Development is slated to start in fall of 2002.  The environmental analysis is expected to result in these projects being categorically excluded from documentation in an Environmental Assessment or Environmental Impact Statement. Project Description: During the spring of 2001, the north end of the Heber District experienced thunderstorm activity accompanied by strong winds. This event resulted in toppling of about 200 Engelmann spruce trees in the Wolf Creek area. Timber stands in these areas are experiencing buildups in spruce beetle populations, and the presence of this many large down spruce trees creates a high potential for accelerating the spruce beetle buildup. The proposal is to remove the down trees via small salvage timber sale.  Less than 100 thousand board feet of timber would be salvaged.

 

Status and Comments:  A Decision/Notice FONSI was released on July 30, 2002.  The project is currently under appeal and waiting for a decision from the Regional Forester.

Project Description:  The proposed action is to re-license the American Fork Hydroelectric Project through the Federal Energy Regulatory Commission (FERC).  Decommissioning and removal of the facilities is being explored as an alternative to relicensing. The project consists of a diversion dam and intake structure, a steel flow line approximately 2.33 miles long, a riveted steel penstock, a powerhouse with one Pelton type turbine/generator unit rated at 1,050 kW, and 12.5 kV transmission line.  The project currently diverts up to 26 cubic feet per seconds (cfs) from the stream for power generation.

 

Status and Comments:  FERC and the project proponents have been acquiring additional information, and FERC and the project proponent are considering this information and the comments, and determining how to proceed.  If FERC and the proponent choose to continue with the proposed relicensing or with decommissioning, then FERC will prepare an EA or EIS following public comments. The Forest Service serves in an advisory role.

Project Description:  The Uinta National Forest is working on several lands transactions.  These are: (1) a Small Tract Act case to resolve trespass issues in Hobble Creek; (2) land title claims on the Pleasant Grove District in the South Fork Provo River area; (3) a land exchange to acquire land for a new office location; (4) land purchases for Dry Canyon Phases I and II, Grove Creek phase II and Mineral Basin; and (5) a land donation located near Strawberry Reservoir. 

 

Status and Comments: The Small Tract Act case is being processed and will be completed this fall or winter. It will take approximately 1 year to complete the land title claims.  The land acquisitions should be processed this winter.  These activities are categories of actions that, barring extraordinary circumstances, are categorically excluded from documentation and a project file and Decision Memo are not required.  The land exchange is in the project proposal development stage and more detailed scoping will occur as the project develops.

Project Description:  The Mutual Dell Organization Camp is requesting permission to complete several facility modifications to improve services provided at the camp.  Site modifications plans have been submitted to upgrade the lodge restrooms for ADA standards, install a pavilion cover on the McDonald site, modify the caretakers home to provide an office, refurbish two vault toilets so they become flush units (two sewer lines will be connected to the existing field septic system); install the Unit C pavilion (all site preparation was approved and construction began in 1986).  These projects had been approved in 1986 but not completed because of lack of funds.

Project Description: Silver Lake is located within the Lone Peak Wilderness approximately two miles upstream from Silver Lake Flat at an elevation of 8,900 feet. Uinta National Forest officials are proposing a stabilization project for Silver Lake Dam. The proposed action includes drilling and blasting to lower the lake’s spillway by five to eight feet from the crest of the dam, and to plug the outlet works with concrete.  The purpose of the project is to reduce environmental and public safety hazards in the event of a dam failure.

 

Status and Comments:  Scoping was originated in 1999; however, the proposed action was refined and scoping was reinitiated on February 28, 2000. The environmental analysis is expected to result in an Environmental Assessment. A decision is expected in the winter of 2002/2003 with project implementation occurring next summer. The project is within the Lone Peak Wilderness so a minimum tool analysis will be prepared.

Project Description:  This section of the Bonneville Shoreline Trail (BST), which will connect the Dry Canyon Trailhead with the Battle Creek Trailhead, follows an illegal two-track trail.  Due to the fragile soils, erosion is occurring creating “pot-holes” and areas of exposed cobble rock within the BST corridor.  The trail would be reconstructed to protect against illegal motorized vehicle access to the BST and bring it to Forest Service standards.

Project Description:  A new trail is needed to access the Lone Peak Wilderness in the Hamangog area.  The old road was closed by the private landowner and a safe trail is needed to provide a route to this popular area.   There is a need for a Right-of-Way across Lehi City property and the private land owner.  He has shown interest in providing an alternate route.

Project Description: The proposal is to harvest trees through a commercial timber sale on about 360 acres of mixed conifer stands within the White River analysis area. The purpose of the project is to salvage dead and dying trees and to improve the overall health of the forested vegetation.  This is a “forest stewardship project”. Status and Comments:  The project proposal has been refined and the project limited to roaded areas.  Re-scoping for this project was initiated in March of 2001.  An Environmental Assessment will be prepared.  The EA is scheduled for completion this winter, and a decision is scheduled to be issued in 2003.  Project implementation could begin as early as the fall of 2003 and continue for a few years thereafter.

Project Description:  The Spanish Fork District is proposing to improve key dispersed recreation sites in the Diamond Fork drainage of the Uinta National Forest, Utah County, Utah.  The work would involve identification of areas where this use is acceptable and possibly would include the construction of facilities at these sites.  A primary consideration in the design of these sites is the need to protect natural resources (soil, water, riparian areas, wetlands, etc.) immediately adjacent to and accessed by these sites.  This project would improve sites through such activities as defining site boundaries, signing, hardening parking surfaces with gravel, and, in some cases, installing restrooms. Many of these sites are currently used as a hub for a variety of recreation uses.

 

Status and Comments: Scoping was initiated last winter. The analysis team has completed site inventories and identified some of the issues.  The environmental analysis resulted in these projects being categorically excluded from documentation in an EA or EIS. Two Decision Memos were issued-- one in May and the other in September, 2002.  Identified maintenance activities would be accomplished in 2003.

Project Description: The Forest Service and the Utah Reclamation Mitigation and Conservation Commission are proposing to develop a group site facility in lower Diamond Fork Canyon to address recreation demand and associated resource impacts.  The proposed project would construct a 475 people-at-one-time (PAOT) group site facility approximately 1.5 miles above the junction of Highway 89. The facility would have three 50 PAOT sites, three 75 PAOT sites, and one 100 PAOT site, five 4 unit vault toilets, paved access road and spurs, shade shelters, a water system, trail system, the establishment of vegetation, a host site, volleyball courts and an information/fee station.  The facility would be constructed in an old agricultural field between the new road and the stream.

 

Status and Comments:  A scoping document was issued in January 2000.  The analysis team has completed site inventories and identified specific issues that need to be addressed. An Environmental Assessment (EA) will be prepared. A pre-decisional EA is scheduled for release in the winter of 2002/2003.

Project Description: The proposal is to reconstruct the existing trail system above the current trailhead location in the Diamond Fork drainage, and to construct a new two-mile section of trail from the Teat Mountain trail system to the Monks Hollow trail system. Status and Comments:  Scoping began in December 1999. Environmental analysis began in January 2000. A pre-decisional EA was issued in October 2000.  Public comments were evaluated and a decision was issued in March 2001. The decision was appealed and subsequently withdrawn for additional review. Additional analysis has been completed and another pre-decisional EA was issued for public comment earlier this year.  A Decision Notice and Finding of No Significant Impact was issued August 15, 2002.  The project is currently under appeal and waiting for a decision from the Regional Forester.

Project Description: The Rays Valley Road is a heavily used Forest arterial travel route that connects with the Diamond Fork Road, and Right Fork Hobble Creek Road at Springville Crossing. These arterial travel routes provide access to and from the Wasatch Front via Left Fork Hobble Creek, to Spanish Fork Canyon and Highway 6 via the Diamond Fork Road and Rays Valley Roads, and to and from the Strawberry Recreation Complex via Rays Valley. The Diamond Fork Road and most of the Rays Valley Road are paved or graveled; however, the reach of the Rays Valley Road directly below Springville crossing is narrow, winding, and native-surfaced. When wet, this road becomes extremely hazardous to travel or impassable. Some of the existing road lies directly adjacent to tributaries of Diamond Fork Creek.  A portion of this route, approximately 1.8 miles, is located in areas of severe slumping and erosive soils.  These soils are easily transported as sedimentation into a stream located, in most cases, less then 100 feet from the road. The nearby stream is perennial and provides habitat for Bonneville cutthroat trout, a sensitive species. Road maintenance costs are high for this segment. The Forest has long planned to reconstruct the Rays Valley Road to address these concerns; however, funding has never been available.

 

Down drainage from Springville Crossing and the Rays Valley Road, the Central Utah Water Conservancy District (CUWCD) is proposing to construct a water conveyance system as part of the Central Utah Project. During construction, the CUWCD is proposing to close some of the Diamond Fork Road above Red Hollow due to safety concerns. This would, during the construction period, greatly restrict recreational access to a large area and would have a major adverse impact on many Forest users. The upper reach of the Rays Valley Road is an alternative access route for Wasatch Front visitors to much of the area during dry periods. To mitigate impacts of closing the Diamond Fork Road, the Department of Interior and CUWCD will cooperate with the Forest Service in reconstruction and relocation of this road. Reconstruction of the Rays Valley Road would address Forest Service concerns about safety, recreational access, soil and watershed conditions, fisheries, and operation and maintenance costs and would also mitigate concerns about safety and recreation access during construction of the CUP.   

 

The proposed reconstructed, relocated road would be about 3.6 miles long, gravel-surfaced, and about 24 feet wide. The proposed relocation or reconstruction of the "new" alignment will be located over more stable soils and in the uplands, away from riparian zones. The existing road will be closed and obliterated and rehabilitated upon completion of the realignment.

 

Status and Comments: Scoping began in August of 1999.  A Notice of Intent was released in April, and an amended NOI was published July 28, 2000 to reflect scheduling changes. A Draft EIS has been completed and was released for public comment and review in winter of 2000.  A Final EIS and Record of Decision were issued in August of 2002.  Implementation is scheduled to begin next spring or summer.  The project is expected to take two years to implement.  The project is currently under appeal and waiting for a decision from the Chief of the Forest Service.

Project Description: The two Districts are re-examining the current travel plan. Travel issues are very similar; therefore, both Districts will work together on the analysis. The finished product will be a travel map of both Districts. Issues currently identified that prompted the revision include clarity of the current plan, mixes of motorized and non-motorized recreational uses, effects on wildlife and water quality and public safety.

 

Status and Comments: The predecisional Environmental Assessment was completed and published on the Internet at http://www.fs.fed.us/wcnf/travel_plan/mtview_evanston/index.html and mailed to interested publics in May with comments due by June 18.  However, in response to the request of several groups, the comment period was extended to October 16, 2001.  The interdisciplinary team is currently reviewing public comments and the final EA and Decision is expected in November.

Project Description: The Forest Service is proposing exchange of easements for administrative use by the Forest Service and for use by a private landowner on an existing road in Sections 7, 8, 17, 18, 19, 29, and 30 in T2N, R12E and in Sections 24 and 25 in T2N, R11E in the West Fork Blacks Fork and Brush Creek drainages.  This road was constructed for timber harvest on private land in the late 1970’s.

 

Status and Comments: A survey of the road location has been completed and public scoping was to be completed in June. The land involved has since changed ownership so a decision will be deferred until the needs of the new landowner can be determined.  This project may be categorically excluded from documentation in an EA or EIS.

Project Description: The Forest Service received a request for seismic exploration in early August of 2001.  The project involves about 270 miles of seismic lines with 30 of those miles being on the National Forest and the rest of it on private and other agency land to the north of the Forest boundary.  Drilling of shot holes on the National Forest will be done entirely with helicopter portable drill rigs that will drill 60-foot holes for the placement of explosive charges.  Helicopter and drilling operations will be limited to low hunter use dates during the Wyoming and Utah big game rifle hunting seasons.

 

Status and Comments: Scoping for this project was completed in early September, 2001 and a Decision Memo categorically excluding this project from documentation in an EA or EIS was signed on September 12, 2001. Work was completed on one of four lines on the National Forest.  There are approximately 20 miles of line remaining to complete. A second Decision Memo categorically excluding the remaining work was signed and the project was completed in September of this year.

Project Description: The purpose of this project is to develop a new allotment management plan on a 16,519 acre grazing allotment within the West Fork of Blacks Fork drainage. The current management plan was approved in 1965 and is therefore not NEPA sufficient.

 

Status and Comments: Based on public comments on the July 1999 Predecisional Environmental Assessment, during the summers of 2000 and 2001 additional work was completed to improve the environmental analysis.  Monitoring of stream channel conditions and ground cover as well as an extensive literature search on ecology of alpine plant communities and ground cover were completed.  In order to incorporate this, additional public review is appropriate prior to a decision.  A public meeting to discuss snowbed ecology was held on July 8, 2002.  A scoping document including a summary of the additional analysis is currently being prepared and will be released this summerPlease contact Rich Zobell at (307) 782-6555 for further information.

Project Description:  The Forest Service is proposing to implement a series of vegetation management treatments in the West Bear drainage area to the west of the Mirror Lake Highway, Utah 150.  The Proposed Action includes both timber harvest and prescribed fire to increase relative amounts of aspen cover, and to mimic natural (without fire suppression) age class ranges and patch sizes of conifers.  It also includes some road construction and reconstruction and evaluation of dispersed campsites to reduce soil erosion that is occurring on some of these sites or their access roads.

 

 Status and Comments:  A Notice of Intent to prepare and environmental impact statement was published in the Federal Register on March 20, 2002A Scoping Document was also released on March 20, 2002, with comments due by April 19, 2002.  An interdisciplinary team is reviewing public comments and developing detailed alternatives for this project. The East Fork Fire that started on June 28 has delayed work on this project for about 1 year.  Please refer to the East Fork Salvage project below.

Project Description:  The Forest Service is proposing to salvage fire-killed timber in the East Fork Bear, Mill Creek, and West Fork Blacks Fork drainages.  Approximately 10,000 acres of forest burned within a 14,000 acre area during the summer of 2002.  Some inventoried roadless areas are within the fire perimeter.  There is potential for timber salvage in many places throughout the burned area.  Some road construction and reconstruction would be needed for access. 

 

Status and Comments:  Scoping and environmental analysis will begin after enough data is gathered to develop a Proposed Action.  A scoping document will be mailed to interested people and organizations shortly after a Proposed Action is developed.

The intent of the proposal is to improve forest health by converting decadent mountain shrub, aspen and aspen/conifer stands to vigorous and more productive vegetation through either mechanical means or prescribed burning. The proposal is to treat about 20,000 acres over the next 5 years. 

 

Status and Comments: Forest Supervisor Tom Tidwell made a decision on June 21, 2002. His decision was appealed by two organizations. On September 4, 2002 he withdrew his decision pending further analysis.

Project Description: The proposal is to construct a new non-motorized trail on a deeded public easement across a corner of private property owned by Deseret Land and Livestock (Deseret) to better access National Forest Lands along Lightning Ridge.  This trail would extend from the gate at the boundary of private and public lands towards the southwest where it would meet the existing Bear Hollow trail.  The Forest Service using mechanized equipment will construct a single-track trail to a width no greater that 60”.  This trail will be approximately one-half mile in length and managed strictly for non-motorized recreation.

PLEASANT GROVE RANGER DISTRICT

 

American Fork River: An ecosystem driven landscape analysis of the American Fork River drainage was initiated in 1998.

EVANSTON RANGER DISTRICT

 

West Fork Bear River: Within the Whitney Management Area an area of 12,000 acres is being analyzed. This project, designed to incorporate the concepts and current knowledge of ecosystem management, is analyzing much of the West Fork Bear River as a single, functioning landscape.

 

An interdisciplinary team has drafted descriptions of the important ecosystem functions that operate on the landscape, such as nutrient and water cycles, energy flows and the role of fire. The team has also drafted a map displaying broad desired landscape components based on historic and desired ecological conditions.  The assessment was completed and mailed to interested parties.  Copies of this assessment are available for review at the Evanston Ranger District Office. Curtis Creek:  This will be a landscape assessment of the vegetation conditions in the Curtis Ridge Area, with an emphasis on spruce conditions.  From this, a long-range strategy for addressing the spruce beetle situation will be developed.  The project will be ecosystem driven and will assist in determining possible management actions to achieve the desired future conditions.  The contact for this assessment is Loren Jepsen.

 

Monte Cristo/Woodruff Drainage:  An area /watershed ecosystem analysis has been initiated for the Monte Cristo/Woodruff drainage.  This will be an assessment of current conditions, key issues, and recommendations for watershed restoration.  Final edits to this assessment are being made.
