Dear Mr. Speaker: The devastation wrought by Hurricane Katrina across the Gulf Coast States has required an unprecedented response by Federal, State, and local governments, as well as the private sector. To date, I have signed into law two supplemental appropriations bills totaling $62.3 billion for hurricane-related disaster relief. To further assist the region in its continued recovery in a fiscally responsible way, I ask the Congress to consider the enclosed reallocation request to provide $17.1 billion in emergency funds for further response and recovery efforts, by reallocating available funding from the Federal Emergency Management Agency's Disaster Relief Fund. I hereby designate this proposal in the amount requested herein as an emergency requirement. This request will provide further assistance to meet the needs of victims, continue the rebuilding and repair of the region's infrastructure, and accelerate the return of Federal agencies to facilities in the region. To further efforts to offset the unprecedented cost of this disaster and control the growth in discretionary spending, I also will be sending you a separate rescissions proposal reducing funding for lower-priority programs and eliminating excess funds. By holding 2006 nonsecurity discretionary spending below a freeze and achieving additional savings through reconciliation legislation, we will advance our efforts to maintain fiscal discipline while continuing to provide for the needs of hurricane-affected States. I urge the Congress to act expeditiously on this request to ensure that the Federal response to these disasters continues uninterrupted. On September 2nd, you signed into law Public Law 109-61, the Emergency Supplemental Appropriations Act to Meet Immediate Needs Arising From the Consequences of Hurricane Katrina, which provided $10.5 billion in emergency supplemental funds for hurricane-related disaster relief. On September 8th, you signed into law Public Law 109-62, the Second Emergency Supplemental Appropriations Act to Meet Immediate Needs Arising From the Consequences of Hurricane Katrina, which provided $51.8 billion in emergency supplemental funds for hurricane-related disaster relief. To further our unprecedented effort to respond to the significant needs of hurricane-affected states, while requiring no net new funding, I submit for your consideration FY 2006 emergency proposals, totaling $17.1 billion, that are reallocated from available funding in the Federal Emergency Management Agency (FEMA) Disaster Relief Fund (DRF). I recommend that you designate the proposals contained in this transmittal as emergency requirements. The remaining amounts available in the DRF are expected to be sufficient through May of 2006 to proceed uninterrupted with ongoing disaster-response efforts underway in the affected regions, state and local infrastructure rebuilding requirements, as well as potential costs arising from Hurricane Wilma. The reallocations are being requested to undertake response and recovery activities in the affected regions that cannot be funded by FEMA under the Stafford Act. This request will provide further assistance to meet the needs of victims, continue the rebuilding and repair of the region's infrastructure, and accelerate the return of federal agencies to facilities in the region. Included in these proposals is a funding request for your initiative on homesteading for residents of hurricane-affected regions. Four of your other initiatives--creating Gulf Opportunity Zones, providing educational assistance for displaced students, providing medical care for evacuees, and creating Worker Recovery Accounts--are proceeding with other legislative vehicles, including reconciliation legislation. We will continue to work toward their prompt enactment. Consistent with your direction to ensure that the affected individuals and States have the resources they need and to provide such assistance in a fiscally responsible manner, this proposal addresses pressing needs through May 2006 that are not covered by the DRF and has no net additional costs. In addition, agencies will also be absorbing over $2 billion in hurricane-related costs within available resources. I anticipate recommending additional funding for further recovery and reconstruction activities in early 2006. To further efforts to offset the unprecedented cost of this disaster and to reduce unnecessary spending, I will be sending you a separate rescissions proposal reducing funding for lower- priority programs and eliminating excess funds. By holding 2006 non-security spending below a freeze and achieving additional savings through reconciliation legislation, we will advance your efforts to maintain fiscal responsibility while continuing to provide for the needs of hurricane-affected states. As described below and in more detail in the enclosures, the requests include the following: Department of Agriculture
$550 million is requested for the Department of Agriculture to provide for the cleanup of agricultural lands and to repair watersheds; to replace Commodity Supplemental Food Program inventory that was destroyed in storage facilities; to provide funding for low-income housing repair and rental assistance; and to fund a grant to States for assistance to timber land owners for timber and debris removal and forest restoration activities. In addition, funding is requested to temporarily relocate the National Finance Center to facilities in Texas, Pennsylvania and other locations, and for facility clean-up and repair needs for two damaged research facilities in Mississippi and Louisiana. Department of Commerce $55 million is requested for the National Oceanic and Atmospheric Administration (NOAA) to provide for the repair of weather-related facilities and observation platforms, including damaged weather buoys and automated surface weather observation stations; acceleration of storm surge and flood forecasting; and rebuilding of a damaged NOAA science center that provides necessary scientific support for fisheries management in the Gulf. Department of Defense $6.6 billion is requested for the Department of Defense, of which $555 million will cover the costs for pay, allowance, and subsistence for active component members and reservists activated for duty in areas affected by Hurricanes Katrina and Rita. The proposal funds $2.15 billion for costs associated with facility repair and restoration of equipment, utilities, and infrastructure at Keesler Air Force Base, Naval Air Station New Orleans, and other locations. These funds also cover the evacuation and per diem costs of military and civilian personnel and their dependents. Another $2.29 billion would cover costs associated with repair of damage to Navy ships, replacement of equipment, funding of production delay costs, and procurement of conventional ammunition stocks that suffered water damage in Navy and Marine Corps facilities. The remaining funds would cover costs associated with planning, design, and construction of facilities that were damaged beyond repair, replacement of test facilities, and repair and replenishment of commissaries. Department of Health and Human Services $590 million is requested of which $90 million is for Head Start facilities repairs and services to children displaced by the hurricanes and $500 million is for the SocialServices Block Grant, which would help affected states provide child care, mental health, and other social services to individuals affected by the recent hurricanes. Department of Homeland Security $431 million is requested to repair and replace critical information technology equipment, as well as replace Customs and Border Protection structures in New Orleans, Louisiana. Funding included for the Coast Guard would provide for cleanup and repair needs at facilities that were damaged by Hurricanes Katrina and Rita, activation of Coast Guard reserve personnel to assist recovery efforts, and for repair of damage to vessels currently under construction as part of the Deepwater program. Requested funding for FEMA would provide $87 million to repair, expand, and improve existing public alert, warning and crisis communications systems in the Gulf Region. Department of Housing and Urban Development $2.2 billion is requested for the costs of restoring housing units in the affected area for low-income families, and to provide for basic infrastructure to restore neighborhoods and communities. The request also includes $390 million for rental assistance and housing placement services for 65,000 Department-assisted households affected by the hurricanes. In addition, the homesteading initiative includes $250 million to offer low-income families, displaced by Hurricane Katrina, the opportunity to become homeowners, after repairing or rebuilding, residential properties previously owned by the government. Department of the Interior $136 million is requested for facility clean-up and repair needs for Gulf Coast sites of the United States Geological Survey, the Fish and Wildlife Service, and the National Park Service, and to restore operations of the Minerals Management Service Gulf of Mexico Regional office. Department of Justice $126 million is requested to support recovery of federal law enforcement by replacing equipment and vehicles, as well as restoring information technology and communications capabilities for the United States Attorneys, the United States Marshals Service, the Federal Bureau of Investigation, the Drug Enforcement Administration, and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Funds are also requested for repairs to prison facilities in the Gulf Coast. Department of Labor $125 million is requested for National Emergency Grants to provide for State assistance, including training and access to temporary jobs, for workers who have been affected by the hurricanes. In addition, language is requested to help affected States to expand their capacity to process claims and expedite unemployment insurance payments for the unemployed. Department of Transportation $2.4 billion is requested to repair and rebuild damaged highways in hurricane-affected areas; repair or replace damaged Federal Aviation Administration control towers, buildings and navigation aids; and repair and reconstruct damaged assets owned by the Maritime Administration and used in conjunction with the U.S. Navy to support the Ready Reserve Force Fleet. Department of Veterans Affairs $1.4 billion is requested to replace the medical center in New Orleans, Louisiana and repair the medical center in Biloxi, Mississippi, destroyed by Hurricane Katrina; replace pharmaceuticals, medical supplies, and equipment for VA hospitals and clinics in the hurricane-affected areas; cover costs to continue veterans' benefits processing; and to clean up and repair damaged national cemeteries. Corps of Engineers $1.6 billion is requested for Corps efforts to repair flood and storm damage to navigation and other projects to pre-Katrina levels. The proposal includes funds to restore navigation locks and channels, repair the levee system, remove hazards to navigation, and provide protection from flooding. The request also includes $250 million to fund Corps efforts that would both benefit the Gulf coastal ecosystem and help restore storm protection to the greater New Orleans metropolitan area by taking steps that lead to the restoration and protection of natural systems. In addition, $4.6 million is requested to conduct an expedited study to determine the best way to reduce risk of future flood and storm damage to the greater New Orleans area. Environmental Protection Agency $75 million is requested to remediate leaking underground storage tanks in areas affected by Hurricanes Katrina and Rita. General Services Administration $75 million is requested to support the restoration and repair of Federal buildings and United States courthouses. National Aeronautics and Space Administration $325 million is requested for repair and replacement of property and information technology infrastructure, environmental remediation, and other recovery needs at the Stennis Space Center in Mississippi and the Michoud Assembly Facility in New Orleans. Small Business Administration $471 million is requested for the Disaster Loan program, which provides funds to homeowners, renters, and businesses to cover uninsured disaster recovery costs including $5 million for the Office of Inspector General to conduct audits, reviews, and investigations of the proper use of funds provided by the Small Business Administration to the victims of Hurricane Katrina and other disasters. Armed Forces Retirement Home $21 million is requested to cover the accommodation and living costs of more than 400 retirees temporarily relocated to the Washington, D.C. facility due to hurricane-related damage to the Gulfport facility. Government-wide Transfer Provision Language is included that would provide authority for any Federal agency to transfer available funding to address emergency needs related to Hurricane Katrina, in order to assist agencies to absorb certain hurricane response and recovery costs. The use of this authority would require notification to the Congress. Reallocation Offset Provision The funds requested above are derived from a reallocation of $17.1 billion from available balances in FEMA's Disaster Relief Fund. Even with this reallocation, sufficient funds would remain available for continued support of hurricane recovery needs, for the rebuilding of State and local infrastructure, and to respond to needs in areas affected by Hurricane Wilma and other potential future disasters. Judicial Branch $66 million is included for the Judicial Branch to reimburse all judges, court staff and Federal public defenders on temporary duty assignment as a result of the hurricanes; and to replace furniture and equipment in affected court locations. As a matter of comity, appropriations requests of the Judicial Branch are commonly transmitted without change. Sincerely, Joshua B. Bolten, Director. Enclosures. DEPARTMENT OF AGRICULTURE Executive Operations WORKING CAPITAL FUND For necessary expenses of ``Working Capital Fund'' related to the consequences of Hurricane Katrina, $70,000,000, to remain available until September 30, 2006: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. The request would provide $70 million to the National Finance Center. The funds are necessary to pay expenses of the National Finance Center as a result of the consequences of Hurricane Katrina, for moving operations to temporary locations until the building in New Orleans, Louisiana is available for occupation. The funds will provide additional salary and expenses costs for temporary duty, overtime, equipment and building rental. ------ DEPARTMENT OF AGRICULTURE Agricultural Research Service SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses,'' $6,000,000, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. The request would provide $6 million for the cleanup, environmental remediation, salvage, and other expenses for the Southern Regional Research Center in New Orleans, Louisiana, related to the consequences of Hurricane Katrina. ------ DEPARTMENT OF AGRICULTURE Agricultural Research Service BUILDINGS AND FACILITIES For an additional amount for ``Buildings and Facilities,'' $9,200,000, to remain available until September 30, 2007 for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. The request would provide $9.2 million to rebuild research facilities that were destroyed or severely damaged at the Agricultural Research Service facility at Poplarville, Mississippi and for planning of repairs needed for the Southern Regional Research Center in New Orleans, Louisiana, as the result of Hurricane Katrina. ------ DEPARTMENT OF AGRICULTURE Farm Service Agency EMERGENCY CONSERVATION PROGRAM For an additional amount for ``Emergency Conservation Program,'' $160,000,000 to remain available until September 30, 2008, for necessary expenses related to Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $160 million for the Farm Service Agency to provide cost-share assistance for emergency measures to clean-up and repair hurricane-related damage of agricultural lands. ------ DEPARTMENT OF AGRICULTURE Natural Resources Conservation Service WATERSHED AND FLOOD PREVENTION OPERATIONS For an additional amount for ``Watershed and Flood Prevention Operations'' for the Emergency Watershed Protection Program, $200,000,000, to remain available until September 30, 2008, for necessary expenses related to Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $200 million for the Natural Resources Conservation Service to provide cost-share assistance for emergency measures to retard runoff, prevent soil erosion, and repair watersheds for hurricane-related damage. ------ DEPARTMENT OF AGRICULTURE Rural Housing Service RURAL HOUSING ASSISTANCE GRANTS For an additional amount for ``Rural Housing Assistance Grants'' for very low-income house repair grants for repairs related to Hurricanes Katrina and Rita, $10,000,000, to remain available until September 30, 2007: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose: Provided further, That these funds are not subject to any age limitation. This request would provide $10 million for housing repair grants to poor rural homeowners who, with financial assistance for repairs, would be able to continue living in their home. Rural Housing Assistance grants are usually limited to recipients who are 62 years and older. However, for this proposal, that age limitation would be lifted. ------ DEPARTMENT OF AGRICULTURE Rural Housing Service RENTAL ASSISTANCE PROGRAM For an additional amount for ``Rental Assistance Program'' account, $17,000,000 for the purpose of reimbursing funds used for rental assistance agreements entered into or renewed pursuant to the authority under section 521(a)(2) for emergency needs related to Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $17 million to replenish the reserve accounts for rental assistance grants, which were used to provide temporary housing rental assistance in Department of Agriculture financed properties following the hurricanes. ------ DEPARTMENT OF AGRICULTURE Rural Housing Service RURAL HOUSING INSURANCE FUND PROGRAM For gross obligations for the additional principal amount of direct housing repair loans related to Hurricanes Katrina and Rita to be available from funds in the Rural Housing Insurance Fund, a maximum of $68,376,069. For an additional amount ``Rural Housing Insurance Fund Program'' account, for the cost of direct loans as authorized by title V of the Housing Act of 1949, for housing repairs related to Hurricanes Katrina and Rita, including the cost of modifying such loans as defined in section 502 of the Congressional Budget Act of 1974, $10,000,000, to remain available until September 30, 2007: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide for housing repair loans to low- income rural homeowners who, with financial assistance for repairs, would be able to continue living in their home. ------ DEPARTMENT OF AGRICULTURE Food and Nutrition Service COMMODITY ASSISTANCE PROGRAM For an additional amount for ``Commodity Assistance Program'' to replace Commodity supplemental Food Program inventories destroyed by Hurricane Katrina, $4,000,000; Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. These funds would be used to replace Commodity Supplemental Food program inventories which were in storage in the New Orleans area and were destroyed as a result of Hurricane Katrina. ------ DEPARTMENT OF AGRICULTURE Forest Service CAPITAL IMPROVEMENT AND MAINTENANCE For an additional amount for ``Capital Improvement and Maintenance,'' $13,900,000, to remain available until September 30, 2007, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purposes. This request would provide $13.9 million for the Forest Service to repair roads in affected National Forests and to repair or replace hurricane-related damage to bridges and other facilities. ------ DEPARTMENT OF AGRICULTURE Forest Service FORESTRY DISASTER ASSISTANCE FUND There is hereby established in the Treasury the Forestry Disaster Assistance Fund. Amounts appropriated to the Fund shall be available for a program of cost-share grants to States related to the consequences of Hurricane Katrina, to provide assistance to timber land owners for debris removal, timber salvage, wildfire mitigation, and wildlife habitat stabilization. For the necessary expenses of the Fund, $50,000,000, to remain available until September 20, 2007; Provided, That the Congress designates this amount as an emergency requirement for this purpose. This request would provide a forestry disaster fund to provide a one-time cost-share grant to states for assistance to timber land owners for debris removal, timber salvage, wildfire mitigation, and wildlife habitat stabilization. ------ DEPARTMENT OF AGRICULTURE General Provision Sec. __. Funds provided for Hurricanes Katrina and Rita under the headings, ``Rural Housing Insurance Fund'' and ``Rural Housing Assistance Grants,'' may be transferred between such accounts at the Secretary's discretion. This language would allow resources to be transferred between housing repair loans and housing repair grants, which are funded in separate accounts. ------ DEPARTMENT OF COMMERCE National Oceanic and Atmospheric Administration OPERATIONS, RESEARCH, AND FACILITIES For an additional amount for ``Operations, Research, and Facilities,'' $17,200,000, to remain available until expended, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $17.2 million for the Operations, Research, and Facilities account to provide for the repair of weather-related facilities including damaged weather forecasting offices; unplanned operational costs for weather forecasting activities; upgrades and enhancements of hurricane forecasting instruments; and acceleration of storm surge and flood forecasting. ------ DEPARTMENT OF COMMERCE National Oceanic and Atmospheric Administration PROCUREMENT, ACQUISITION AND CONSTRUCTION For an additional amount for ``Procurement, Acquisition and Construction,'' $37,400,000, to remain available until expended, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $37.4 million for the Procurement, Acquisition and Construction account for the repair of weather-related facilities and observation platforms including damaged weather buoys and automated surface weather observation stations; upgrades and enhancements of hurricane forecasting instruments including the addition of back-up power and communications to coastal weather stations and instruments sites and an additional aircraft to improve observations of hurricanes; and temporary operating space as well as requirements for a damaged NOAA science center that provides necessary scientific support for fisheries management in the Gulf. ------ DEPARTMENT OF DEFENSE Military Personnel MILITARY PERSONNEL, ARMY For an additional amount for ``Military Personnel, Army,'' $29,830,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide for subsistence for approximately 5,400 active component members supporting the hurricane-relief efforts. It would also provide per diem for approximately 3,300 evacuated military dependents. ------ DEPARTMENT OF DEFENSE Military Personnel MILITARY PERSONNEL, NAVY For an additional amount for ``Military Personnel, Navy,'' $57,691,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide for pay, allowances, subsistence, and other personnel costs for reserve members activated for duty in areas affect by the hurricanes. These members continue to assess damaged housing units and assets and provide administrative support. The funding also provides per diem for approximately 7,000 evacuated military dependents. ------ DEPARTMENT OF DEFENSE Military Personnel MILITARY PERSONNEL, MARINE CORPS For an additional amount for ``Military Personnel, Marine Corps,'' $14,193,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide per diem for approximately 1,700 evacuated military dependents. ------ DEPARTMENT OF DEFENSE Military Personnel MILITARY PERSONNEL, AIR FORCE For an additional amount for ``Military Personnel, Air Force,'' $105,034,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide for pay, allowances, subsistence, and other personnel costs for approximately 2,000 reserve members activated for duty in areas affected by the hurricanes. These members are activated to provide: air traffic control capabilities; air traffic support maintenance teams; communications and communications support packages; air space controllers and operations officers to coordinate joint operations; aerial reconnaissance; additional fuel support; and other support services, such as contracting, security, and food services. This funding would also provide subsistence for active component members, housing allowance for displaced military members, and per diem for approximately 6,500 evacuated military dependents. ------ DEPARTMENT OF DEFENSE Military Personnel RESERVE PERSONNEL, ARMY For an additional amount for ``Reserve Personnel, Army,'' $11,100,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would fund pay, allowances, subsistence, travel and related expenses for approximately 500 reserve members activated for duty in areas affected by the hurricanes. It includes funding for Reserve members to assess damage to military housing units, replace or repair damaged housing and other facilities, and provide administrative support to military units deployed in support of relief efforts. ------ DEPARTMENT OF DEFENSE Military Personnel RESERVE PERSONNEL, NAVY For an additional amount for ``Reserve Personnel, Navy,'' $33,015,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would fund pay, allowances, subsistence, travel and related expenses for approximately 600 reserve members activated for duty in areas affected by the hurricanes. The Reserve members are assessing damage to military housing units, replacing or repairing damaged housing and facilities, assisting with security and clean-up efforts at local installations damaged by the hurricane, and providing administrative support to military units deployed in support in relief efforts. This request would also provide per diem for approximately 2,200 evacuated military dependents. ------ DEPARTMENT OF DEFENSE Military Personnel RESERVE PERSONNEL, MARINE CORPS For an additional amount for ``Reserve Personnel, Marine Corps,'' $3,028,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide per diem for approximately 400 evacuated military reservists. ------ DEPARTMENT OF DEFENSE Military Personnel RESERVE PERSONNEL, AIR FORCE For an additional amount for ``Reserve Personnel, Air Force,'' $2,370,000, to remain available until September 30, 2006, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This proposal includes funding for continuity of operations and the necessary resources to cover costs associated with: facility repair and restoration, repair and refurbishment of collateral equipment, hazardous waste disposal and environmental cleanup, utility and electrical repair, aviation unit repair, logistical assistance teams, and logistics and transportation expenses. Examples of some of the activities funded include: buying ``meals-ready-to- eat'' for soldiers supporting relief operations; replacing furniture and supplies destroyed by the storms; providing security fencing for damaged facilities; and replacing uniforms and boots for soldiers operating directly in contaminated areas. Examples of some of the activities funded include: replacing water-damaged ammunition; making critical repairs to family housing units in Gulfport MS, Pascagoula MS, New Orleans, LA, and Meridian MS; funding the flying hours associated with relief for Navy personnel; and, repairing damaged civil engineer support equipment. This request would fund planning and design for family housing construction projects at Keesler Air Force Base in Mississippi to replace lost housing, damaged beyond repair by the high winds and flooding experienced from Hurricane Katrina, for service members and their families. Few adequate homes are available within the commute area or within the Basic Allowance for Housing (BAH) established by the Department of Defense. The status of the infrastructure eliminates the feasibility of a privatization project at Keesler. ------ DEPARTMENT OF DEFENSE Revolving and Management Funds DEFENSE WORKING CAPITAL FUND For an additional amount for ``Defense Working Capital Fund,'' $7,224,000, to remain available until expended, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would fund transportation costs and contingency costs related to Hurricanes Katrina and Rita for Defense Logistics Agency staff; replacement of shelf stock and office equipment destroyed by Hurricane Katrina for the Defense Commissary Agency; and repair, replacement, or payment for equipment damaged or destroyed for Air Force working capital fund entities. ------ DEPARTMENT OF DEFENSE Trust Funds SURCHARGE COLLECTIONS, SALES OF COMMISSARY STORES, DEFENSE For an additional amount for ``Surcharge Collections, Sales of Commissary Stores, Defense,'' $44,341,000, to remain available until expended, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would fund clearing debris and rebuilding the commissaries at Keesler Air Force Base, and Gulfport Naval Construction Battalion Center located in Mississippi and repair commissaries that received damage on the edge of the paths of Hurricane Katrina. ------ DEPARTMENT OF DEFENSE General Provisions Sec. __. Upon his determination that such action is necessary to ensure the appropriate allocation of funds provided in this Act, the Secretary of Defense may transfer up to $750,000,000 of the funds made available to the Department of Defense in this Act (including military construction appropriations) between such appropriations: Provided, That the Secretary shall notify the Congress promptly of each transfer made pursuant to this authority: Provided further, That the transfer authority provided in this section is in addition to any other transfer authority available to the Department of Defense. This provision would allow transfers in this bill, including the military construction accounts. Absent this legislative provision, the Department of Defense's (DOD) flexibility to react to changing conditions as a result of Hurricanes Katrina and Rita is restricted. This provision ensures that transferred funds remain available for the purpose and life of the account to which they are transferred. Sec.__. Notwithstanding 10 U.S.C. 701(f), the Secretary of Defense may authorize a member on active duty who performed duties in support of Hurricanes Katrina or Rita disaster relief operations and who, except for this seciton, would lose any accumulated leave in excess of 60 days at the end of fiscal year 2005, to retain an accumulated leave total not to exceed 120 days leave. Except as provided in 10 U.S.C. 701(f), leave in excess of 60 days accumulated under this section is lost unless it is used by the member before October 1, 2007. This provision would ensure that the more than 50,000 service members deployed to perform duties in support of Hurricanes Katrina or Rita, and who were precluded from taking leave due to the urgency of their duties, do not lose accumulated leave in fiscal year 2005. Sec. __. Notwithstanding 37 U.S.C. 403(b), the Secretary of Defense may prescribe a temporary adjustment in the geographic location rates of the basic allowance for housing in a military housing area located within an area declared a major disaster under the Robert T. Stafford Disaster Relief and Emergency Act (42 U.S.C. 5121 et seq.) resulting from Hurricanes Katrina and Rita. (a) Such temporary adjustment shall be based upon the Secretary's redetermination of housing costs in an affected area and at a rate that shall not exceed 20 percent of the current rate for an affected area. (b) Members in an affected military housing area must certify that an increased housing cost above the current rate for an affected area has been incurred in order to be eligible for the temporary rate adjustment. (c) No temporary adjustment may be made after September 30, 2006. No assistance provided to individual households under this heading may extend beyond January 1, 2007. Further, the Secretary is authorized to reduce or eliminate any temporary adjustment granted under subsection (a) prior to such date as appropriate. This provision is necessary to adjust Basic Allowance for Housing (BAH) rates for military housing areas affected by Hurricanes Katrina and Rita. Section 403(a)(1) of title 37, United States Code, authorizes a member entitled to basic pay a BAH. Revisions to the rates are authorized only when basic pay under section 1009 of title 37, United States Code, is increased, typically on January 1 of each year. However, housing costs measured over the past summer to establish housing allowance rates for the calendar year of 2006 no longer accurately reflect the cost of housing in the affected areas. This revision will allow a member assigned to an area affected by the Federal Major Disaster associated with Hurricanes Katrina and Rita to obtain an increased temporary BAH upon return to the affected area, provided that the member can certify an increased housing cost. Newly assigned members are also eligible to receive the allowance. The amount of the BAH increase, which shall not exceed 20 percent, will be based upon a temporary reassessment of housing costs by the Secretary of Defense. A service member's entitlement to an increased allowance is contingent upon approval by the service secretary or appointed representative, consistent with appropriate implementing guidance or regulations approved by the Secretary of Defense. No service member can begin receiving the temporary adjustment after September 30, 2006. The temporary BAH rate shall remain in effect until the Secretary of Defense renders a redetermination of the median costs in the affected military housing area and establishes a new BAH rate, consistent with section 403(b)(4) of title 37, United States Code, on January 1, 2007. The Secretary may reduce or eliminate the temporary adjustment prior to January 1, 2007. Sec. __. Funds appropriated by this title may be obligated and expended notwithstanding section 504(a)(1) of the National Security Act of 1947 (50 U.S.C. 414(a)(1)). This proposed waiver is necessary in order to authorize DOD and the Intelligence Community to obligate supplemental funds for activities funded through the National Intelligence Program. ------ DEPARTMENT OF HEALTH AND HUMAN SERVICES Administration for Children and Families CHILDREN AND FAMILIES SERVICES PROGRAMS For an additional amount for ``Children and Families Services Programs,'' $90,000,000, for Head Start to serve children displaced by Hurricanes Katrina and Rita, notwithstanding sections 640(a)(1) and 640(g)(1) of the Head Start Act, and to cover the costs of renovating those Head Start facilities which were affected by these hurricanes, to the extent reimbursements from FEMA and insurance companies do not fully cover such costs: Provided, That the Congress designates the amounts provided herein as an emergency requirement for these specific purposes. The request for the Department of Health and Human Services (HHS) provides $90 million to fund Head Start and Early Head Start services to children displaced by Hurricanes Katrina, Rita, and Ophelia and for facilities reconstruction and repair. Reimbursement for facility repairs will be available only to the extent that private insurance or FEMA does not fully cover such costs. The Head Start program provides grants to local public and private non-profit and for-profit agencies to provide comprehensive child development services. Intended primarily for preschoolers from low-income families, Head Start promotes school readiness by enhancing the social and cognitive development of children through the provision of educational, health, nutritional, social and other services to enrolled children and families. ------ DEPARTMENT OF HEALTH AND HUMAN SERVICES Administration for Children and Families SOCIAL SERVICES BLOCK GRANT For an additional amount for ``Social Services Block Grant,'' $500,000,000, for necessary expenses related to the consequences of Hurricane Katrina, notwithstanding section 2003 of the Social Security Act (42 U.S.C. 1397b): Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This proposal would provide $500 million to support the cost of providing social services to individuals evacuated or displaced from permanent homes as a result of Hurricane Katrina. ------ DEPARTMENT OF HOMELAND SECURITY Customs and Border Protection SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses'' to repair and replace critical equipment and property damaged by Hurricane Katrina, $27,100,000: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide an additional $27.1 million to Customs and Border Protection for the repair and replacement of critical IT equipment and other property lost in the hurricane. ------ DEPARTMENT OF HOMELAND SECURITY Customs and Border Protection CONSTRUCTION For an additional amount for ``Construction'' to rebuild and repair structures damaged by Hurricane Katrina, $26,700,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for this specific propose. This request would provide an additional $26.7 million to Customs and Border Protection (CPB) for build-out costs; replacement items, including the laboratory and seizure vault; and, other tenant improvements to rebuild CBP structures in New Orleans, Louisiana. ------ DEPARTMENT OF HOMELAND SECURITY Immigration and Customs Enforcement SALAIRES AND EXPENSES For an additional amount for ``Salaries and Expenses'' to repair and replace critical equipment and property damaged by Hurricane Katrina, $13,848,000: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide an additional $13.8 million to Immigration and Customs Enforcement (ICE) for the repair and replacement of critical information technology and communications equipment, as well as repair of ICE facilities. ------ DEPARTMENT OF HOMELAND SECURITY United States Coast Guard OPERATING EXPENSES For an additional amount for ``Operating Expenses'' for necessary expenses related to the consequences of Hurricanes Katrina and Rita, $139,335,000, to remain available until expended, of which up to $400,000 may be used for environmental clean-up and restoration of Coast Guard facilities; and of which up to $525,000 may be used for salvage and repair of research and development equipment and facilities: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide additional funds to the U.S. Coast Guard for clean-up and repair needs at facilities that were damaged by Hurricanes Katrina and Rita, activation of reservists to assist in Hurricanes Katrina and Rita recovery efforts, and repair or replacement of equipment, materials and supplies lost due to the hurricanes. ------ DEPARTMENT OF HOMELAND SECURITY United States Coast Guard ACQUISITION, CONSTRUCTION AND IMPROVEMENTS For an additional amount for ``Acquisition, Construction and Improvement'' for necessary expenses related to the consequences of Hurricanes Katrina and Rita, $136,660,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide additional funds to the U.S. Coast Guard for major repair and reconstruction projects for facilities that were damaged by Hurricanes Katrina and Rita, and for damage to vessels currently under construction as part of the Deepwater program. ------ DEPARTMENT OF HOMELAND SECURITY Federal Emergency Management Agency ADMINISTRATIVE AND REGIONAL OPERATIONS For an additional amount for ``Administrative and Regional Operations'' for necessary expenses related to Hurricane Katrina and Rita, $87,100,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide additional funds to the Federal Emergency Management Agency to improve procurement capacity, oversight and business process evaluation, and to repair, expand, and improve existing public alert, warning and crisis communications systems in the Gulf Region. ------ DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT Community Planning and Development COMMUNITY DEVELOPMENT FUND For an additional for ``Community Development Fund'' for necessary expenses related to the consequences for Hurricane Katrina, $1,500,000,000, to remain available until September 30, 2008 for activities authorized by title I of the Housing and Community Development Act of 1974: Provided, That such funds may not be used for activities reimbursable by the Federal Emergency Management Agency, the Small Business Administration, or activities available through the Army Corps of Engineers, or for reimbursement for expenditures incurred from the regular Community Development Block Grant formula allocation used to achieve these same purposes: Provided further, That notwithstanding section 106 of such Act, the Secretary shall allocate these funds as the Secretary determines appropriate and such allocation may be based on the population and needs of the designated disaster areas within the affected States: Provided further, That the Secretary shall also prescribe the eligible uses of such funds and approve the expenditure of such funds: Provided further, That the Secretary shall publish a notice in the Federal Register that announces the fund allocation method, the eligible uses of the funds, and the manner of approval of fund expenditure: Provided further, That the Secretary may waive, or specify alternative requirements for, any provision of any statute or regulation that the Secretary administers in connection with the obligation by the Secretary or the use by the recipient of these funds, except for requirements related to fair housing, nondiscrimination, labor standards, and the environment, upon a finding that such waiver is required to facilitate the use of such funds, and would not be inconsistent with the overall purpose of the statute or regulation: Provided further, That the Secretary shall publish in the Federal Register any waiver of any statute or regulation authorized under this heading no later than 5 days before the effective date of such waiver: Provided further, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide $1.5 billion for the Community Development Block Grant program. Funds would be used to assist states in providing housing, basic infrastructure, and other needs associated with rebuilding communities devastated by the hurricane. ------ DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT Community Planning and Development COMMUNITY DEVELOPMENT FUND For an additional amount for ``Community Development Fund'' for necessary expenses related to the consequences of Hurricane Katrina, $50,000,000 to remain available until September 30, 2010, of which up to $500,000, may be used for technical assistance: Provided, That such funds are for activities authorized under section 11 of the Housing Opportunity Program Extension Act of 1996, as amended, and for demolition, site clearance and remediation, and program administration: Provided further, That the Secretary if authorized to extend for up to 36 months the period during which a grantee or affiliate is to use grant amounts, notwithstanding section 11(i)(5) and (j) of such Act: Provided further, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $50 million for the Self-Help Housing Opportunity Program (SHOP). This includes $10 million in administrative costs and $40 million for land acquisition, infrastructure improvement, demolition, site clearance and remediation, to provide 2,000 estimated housing units for low- income families and facilitate an urban homesteading program. ------ DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT Community Planning and Development HOME INVESTMENT PARTNERSHIPS PROGRAM For an additional amount for ``HOME Investment Partnerships Program'' for necessary expenses related to the consequences of Hurricane Katrina, $70,000,000, to remain available until September 30, 2008: Provided, That such funds are for activities authorized under Title II of the Cranston-Gonzalez National Affordable Housing Act, as amended: Provided further, That such funds may not be used for activities which are reimbursable from funds made available by the Federal Emergency Management Agency: Provided further, That notwithstanding section 217 of the such Act, the Secretary may allocate these funds based on the population and low-income housing needs of eligible participating jurisdictions in the Katrina-affected areas: Provided further, That the Secretary shall publish a notice in the Federal Register of the factors to be considered in the fund allocation method under this heading before the effective date of such allocation: Provided further, That in administering these funds, the Secretary may waive, or specify alternative requirements for, any provision of any statute or regulation that the Secretary administers in connection with the obligation by the Secretary or any use by the recipient of these funds, except for statutory requirements relating to fair housing and nondiscrimination, labor standards, the environment, requirements that activities benefit persons of low- and moderate-income, and that housing qualify as affordable housing pursuant to section 290 of such Act, upon finding that such waiver is required to facilitate the obligation and use of such funds, and would not be inconsistent with the overall purpose of the statute or regulation: Provided further, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $70 million for the HOME Investment Partnership Program for new construction, acquisition, and rehabilitation of affordable housing (including repair of HUD subsidized housing), and is estimated to assist approximately 4,000 to 4,500 housing units in the Katrina-affected areas. ------ DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT Public and Indian Housing Programs KATRINA DISASTER HOUSING ASSISTANCE PROGRAM For housing vouchers for households within the area declared a major disaster under the Robert T. Stafford Disaster Relief and Emergency Act (42 U.S.C. 5121 et seq.) resulting from Hurricane Katrina, $390,299,500: Provided, That such households shall be limited to those which, prior to Hurricane Katrina, received assistance under section 8 or 9 of the United States Housing Act of 1937, section 801 or 811 of the Cranston- Gonzalez National Affordable Housing Act, the AIDS Housing Opportunity Act, or the Stewart B. McKinney Homeless Assistance Act; or those which were homeless or in emergency shelters in the declared disaster area prior to Hurricane Katrina: Provided further, That these funds are available for assistance, under section 8(o) of the United States Housing Act of 1937: Provided further, That in administering assistance under this heading the Secretary of Housing and Urban Development may waive requirements for income eligibility and tenant contribution under section 8 of such Act: Provided further, That no assistance provided to individual households under this heading may exceed 18 months in duration. This request would provide $390 million for six months for rental assistance and housing placement services by public housing authorities for 65,000 HUD assisted households and previously homeless persons affected by the hurricane and registered with FEMA. Funding would not be available to duplicate rental assistance provided by FEMA. ------ DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT Public and Indian Housing ADMINISTRATIVE PROVISION Sec. __. Notwithstanding provisions of the United States Housing Act of 1937, in order to assist public housing agencies located within an area that is subject to a declaration by the President of a major disaster or emergency under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.) in connection with Hurricane Katrina, the Secretary may authorize a public housing agency to combine assistance provided under sections 9(d) and (e) of the United States Housing Act of 1937 (42 U.S.C. 1437g(d) and (e)) and assistance provided under section 8(o) of such Act (42 U.S.C. 1437f(o)), for the purpose of facilitating the prompt, flexible and efficient use of funds provided under these sections of the Act to assist families who were receiving housing assistance under the Act immediately prior to Hurricane Katrina and displaced from their housing by the hurricane. This proposal would provide flexibility to local public housing authorities in the area affected by Katrina to help displaced low-income households meet their current housing needs and later by restoring and operating damaged public housing, using funds previously appropriated for one purpose or the other. ------ DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT Housing Programs HURRICANE KATRINA RECOVERY HOMESTEADING For ``Hurricane Katrina Recovery Homesteading,'' for activities authorized under the Hurricane Katrina Recovery Homesteading Act of 2005, $200,000,000, to remain available until September 30, 2010; of which not more than $10,000,000 may be used for technical assistance and administrative expenses of States and local government: Provided, That amounts made available herein may be transferred to ``Mutual Mortgage Insurance Program Account,'' Department of Housing and Urban Development; ``General and Special Risk Program Account,'' Department of Housing and Urban Development; ``Housing Program Account,'' Department of Veterans Affairs; and ``Rural Housing Insurance Fund Program Account,'' Department of Agriculture, for the costs of modifying guaranteed loans, as defined in section 502 of the Congressional Budget Act of 1974, held by such agencies on properties which are transferred pursuant to section 4 of the Hurricane Katrina Recovery Homesteading Act: Provided further, That these amounts are available only upon enactment of the Hurricane Katrina Recovery Homesteading Act: Provided further, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. The Department of Housing and Urban Development (HUD) has proposed establishing a homesteading initiative that offers low-income families who were displaced by Hurricane Katrina the opportunity to obtain residential properties owned by the Federal government. Under this initiative, the Secretary of the Department of Housing and Urban Development is authorized to reimburse FHA, participating federal agencies, and private donors for property that the Secretary acquires for the purposes of this program. Since these reimbursements will be nominal in amount, HUD will incur a modification cost to make up the difference between its current reimbursement and the original estimate for property disposition. Recipients of assistance are families who formerly resided in and plan to resettle in the areas affected by Hurricane Katrina. ------ DEPARTMENT OF THE INTERIOR Minerals Management Service ROYALTY AND OFFSHORE MINERALS MANAGEMENT For an additional amount for ``Royalty and Offshore Minerals Management'' for necessary expenses related to the consequences of Hurricane Katrina and for repayment of advances to other appropriation accounts from which funds were transferred for such purposes, $31,500,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide additional funds to the Minerals Management Service (MMS) to relocate the MMS Gulf of Mexico regional office from Louisiana to Houston, Texas. Funding covers the immediate recovery costs to purchase new equipment and find temporary offices, plus additional operational costs during the first six months. ------ DEPARTMENT OF THE INTERIOR United States Geological Survey SURVEYS, INVESTIGATIONS, AND RESEARCH For an additional amount for ``Surveys, Investigations, and Research'' for necessary expenses related to the consequences of Hurricanes Katrina and Rita and for repayment of advances to other appropriation accounts from which funds were transferred for such purposes, $5,300,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide additional funds to the United States Geological Survey (USGS) for facility and streamgage repair needs at USGS sites in the Southeast that were damaged by Hurricanes Katrina and Rita. ------ DEPARTMENT OF THE INTERIOR Fish and Wildlife Service CONSTRUCTION For an additional amount for ``Construction'' for necessary expenses related to the consequences of Hurricanes Katrina and Rita, $61,000,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide additional funds to the Fish and Wildlife Service for immediate clean-up and facility repair needs at 30 national wildlife refuges in the Southeast that were damaged by Hurricanes Katrina and Rita. ------ DEPARTMENT OF THE INTERIOR National Park Service CONSTRUCTION For an additional amount for ``Construction'' for necessary expenses related to the consequences of Hurricanes Katrina and Rita, $38,000,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. Funds are not intended to offset personnel related costs or rental costs associated with replacement of GSA-managed or owned property, with the exception of law-enforcement specific above-standard costs. ------ DEPARTMENT OF JUSTICE Drug Enforcement Administration SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses,'' $12,700,000, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. The resources will be used to replace equipment and vehicles that were destroyed in the hurricane and its aftermath, set up short-term relocated field offices, and fund other DEA property-related expenses. The resources will be used to replace equipment and vehicles that were destroyed in the hurricane and its aftermath. These resources will also be used to set up short- term relocated field offices restore information technology and communications capabilities. Funds are not intended to offset personnel related costs or rental costs associated with replacement of GSA managed or owned property, with the exception of law-enforcement specific above-standard costs. ------ DEPARTMENT OF JUSTICE Federal Prison System BUILDINGS AND FACILITIES For an additional amount for ``Buildings and Facilities,'' $18,000,000, to remain available until expended, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $18 million for the Federal Prison System to repair prisons damaged by hurricanes in the Gulf Coast region, including facilities in Miami and Tallahassee, Florida; Yazoo City, Mississippi; Memphis, Tennessee; and in Beaumont, Oakdale, and Texarkana, Texas. Funds are not intended to offset personnel related costs or rental costs associated with replacement of GSA managed or owned property, with the exception of law-enforcement specific above-standard costs. ------ DEPARTMENT OF LABOR Employment and Training Administration TRAINING AND EMPLOYMENT SERVICES For an additional amount for ``Training and Employment Services'' to award national emergency grants under section 173 of the Workforce Investment Act of 1998 related to the consequences of Hurricanes Katrina and Rita, $125,000,000, to remain available until June 30, 2006: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This proposal would provide supplemental funding of $125 million for National Emergency Grants (NEGs)--which are authorized under section 173 of the Workforce Investment Act (WIA)--to States to assist workers who have been affected by the hurricanes. These funds would be available for obligation through June 30, 2006. Under WIA, States may apply to the Secretary of Labor for NEGs, which provide special funding to respond to emergencies, major disasters, or major economic dislocations (including plant closures, mass layoffs, or closures and realignments of military installations). NEGs finance temporary, disaster- relief employment for dislocated workers to clean up and restore disaster areas and to provide food, clothing, shelter, and other humanitarian assistance for disaster victims. In additional, NEGs may finance traditional employment services, such as job training and placement assistance, supportive services, and limited needs-related payments. ------ DEPARTMENT OF LABOR Employment and Training Administration STATE UNEMPLOYMENT INSURANCE AND EMPLOYMENT SERVICE OPERATIONS Funds provided under this heading in Public Law 108-447 which have been allocated to the States of Alabama, Louisiana, and Mississippi for activities authorized by title III of the Social Security Act, as amended, shall remain available for obligation by such States through September 30, 2006, except that funds used for automation by such States shall remain available through September 30, 2008. This proposal would extend the obligation period from December 31, 2005, to September 30, 2006, for funds provided under the FY 2005 appropriation for grants to States for Unemployment Insurance (UI) administration. Funds used for automation will have their period of availability extended for an additional year, from September 30, 2007, to September 30, 2008. This extension would be limited to the States of Alabama, Louisiana, and Mississippi. The Department of labor has provided $28.2 million in FY 2005 funds to help States expand their capacity to process and expedite unemployment insurance payments for those left unemployed as a result of Hurricane Katrina. Some of these funds will help repair or rebuild damaged facilities along the Gulf Coast; other funds will support expanded information technology capacity to handle the increased number of weekly unemployment claims expected. However, these States have only until December 31, 2005 to obligate the funds for repair and rebuilding; they have until September 30, 2007 to obligate funds for information technology. Extending the obligation period for the affected States will allow more careful planning for recovery. ------ DEPARTMENT OF TRANSPORTATION Federal Aviation Administration FACILITIES AND EQUIPMENT For an additional amount for ``Facilities and Equipment,'' $40,600,000, to be derived from the Airport and Airway Trust Fund and to remain available until expended, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $40.6 million for the Federal Aviation Administration's (FAA) Facilities and Equipment account for emergency hurricane-related response activities. Multiple FAA facilities including control towers, buildings and navigation aids were damaged by the recent hurricanes and need to be repaired or replaced. ------ DEPARTMENT OF TRANSPORTATION Federal Highway Administration EMERGENCY RELIEF PROGRAM For an additional amount for ``Emergency Relief Program'' as authorized under 23 U.S.C. 125, $2,325,000,000, to remain available until expended, from the General Fund, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That notwithstanding 23 U.S.C. 120(e) and from funds provided herein, the Federal share for all projects for repairs or reconstruction of highways, roads, and trails to respond to damage caused by Hurricane Katrina shall be 100 percent: Provided further, That notwithstanding 23 U.S.C. 125(d)(1), the Secretary of Transportation may obligate more than $100,000,000 for such projects in a State in a fiscal year, to respond to damage caused by Hurricane Katrina: Provided further, That any amounts in excess of those necessary for emergency expenses relating to the above hurricane may be used for other projects authorized under 23 U.S.C. 125: Provided further, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide an additional $2.3 billion to the Department of Transportation (DOT) for repairing and rebuilding damaged highways eligible for assistance under the Federal Highway Administration's Emergency Relief program. The proposal would make funds available until expended; lift the program's $100 million per State per event cap; and would waive the State matching share requirements for all of the Katrina- related Emergency Relief projects. In addition, if the funds provided exceed the program's requirements for Hurricane Katrina, this proposal would allow DOT to spend excess funds on other Emergency Relief projects. ------ DEPARTMENT OF TRANSPORTATION Maritime Administration OPERATIONS AND TRAINING For an additional amount for ``Operations and Training,'' $7,500,000, to remain available until September 30, 2007, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide an additional $7.5 million to the Department of Transportation to repair and reconstruct the Poland Street pier and warehouse in New Orleans, Louisiana, damaged as a result of Hurricane Katrina. These assets are owned by the Maritime Administration and are used in conjunction with the U.S. Navy to support the Ready Reserve Force Fleet. ------ DEPARTMENT OF VETERANS AFFAIRS Veterans Health Administration MEDICAL SERVICES For an additional amount for ``Medical Services,'' $198,265,000 for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $198.3 million for the Department of Veterans Affairs (VA) to replace pharmaceuticals, medical supplies, equipment, and other miscellaneous medical costs for VA hospitals and clinics in the Gulf Coast region as a consequence of Hurricanes Katrina and Rita. ------ DEPARTMENT OF VETERANS AFFAIRS Departmental Administration GENERAL OPERATING EXPENSES For an additional amount for ``General Operating Expenses,'' $24,871,289 for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide an additional $24.9 million for the Department of Veterans Affairs for furnishing and activating a new regional office in New Orleans, Louisiana, as well as miscellaneous operating costs to continue veteran's benefits processing. ------ DEPARTMENT OF VETERANS AFFAIRS Departmental Administration NATIONAL CEMETERY ADMINISTRATION For an additional amount for ``National Cemetery Administration,'' $200,000, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide an additional $200,000 for the Department of Veterans Affairs to clean up and repair national cemeteries damaged as a consequence of Hurricane Katrina. ------ DEPARTMENT OF VETERANS AFFAIRS Departmental Adminstration CONSTRUCTION, MAJOR PROJECTS For an additional amount for ``Construction, Major Projects,'' $1,155,000,000, to remain available until expended, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide an additional $1.2 billion for the Department of Veterans Affairs to replace the medical center in New Orleans, Louisiana, and repair and add a bed tower to the medical center in Biloxi, Mississippi, destroyed as a consequence of Hurricane Katrina. ------ DEPARTMENT OF VETERANS AFFAIRS Departmental Adminstration CONSTRUCTION, MAJOR PROJECTS For an additional amount for ``Construction, Major Projects,'' $1,800,000, to remain available until expended, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide and additional $1.8 million for the Department of Veterans Affairs for repair of damaged roadways and repair of other damage to national cemeteries from Hurricane Katrina. Approximately seven cemeteries were affected by the hurricane, but most of the funds will be used at the Biloxi, Mississippi cemetery. ------ DEPARTMENT OF VETERANS AFFAIRS General Provision Sec. __. (a) Notwithstanding 38 U.S.C. 2102, the Secretary of Veterans Affairs may make a grant to a veteran whose home was previously adapted with the assistance of a grant under chapter 21 of Title 38, United States Code, in the event the adapted home which was being used and occupied by the veteran was destroyed or substantially damaged in the area declared the Hurricane Katrina or Hurricane Rita disaster area, as determined by the President under the Disaster Relief and Emergency Assistance Act (42 U.S.C. Sec. 5121 et seq.). The grant is available to acquire a suitable housing unit with special fixtures or moveable facilities made necessary by the veteran's disability, and necessary land therefor. This authority expires on September 30, 2006. (b) The amount of the grant authorized by this subsection may not exceed the lesser of: (1) the reasonable cost, as determined by the Secretary of Veterans Affairs, of repairing or replacing the adapted home in excess of the available insurance coverage on the damaged or destroyed home; or (2) the maximum grant to which the veteran would have been entitled under 38 U.S.C. 2102 (a) or (b) had the veteran not obtained the prior grant. Sec. __. In any case where the Secretary of Veterans Affairs determines that a veteran described in 38 U.S.C. 3108(a)(2) has been displaced as the result of Hurricanes Katrina and Rita, from the disaster area, as determined by the President under the Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.), the Secretary may extend the payment of subsistence allowance authorized by such paragraph for up to an additional two months while the veteran is satisfactorily following such program of employment services. This authority expires on September 30, 2006. Sec. __. The annual limitation contained in 38 U.S.C. 3120(e) shall not apply in any case where the Secretary of Veterans Affairs determines that a veteran described in 38 U.S.C. 3120(b) has been displaced as the result of, or has otherwise been adversely affected in the areas covered by Hurricanes Katrina and Rita, as determined by the President under the Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.). This authority expires on September 30, 2006. Sec. __. Notwithstanding 38 U.S.C. 3903(a), the Secretary of Veterans Affairs my provide or assist in providing an eligible person with a second automobile or other conveyance under the provisions of Chapter 39, Title 38 United States Code, if the Secretary receives satisfactory evidence that the automobile or other conveyance previously purchased with assistance under such chapter was destroyed as a result of Hurricane Katrina or Rita, and through no fault of the eligible person: Provided, That that person does not otherwise receive from a property insurer compensation for the loss. This authority expires on September 30, 2006. This proposal would provide the following: Subsection (a) authorizes the Secretary to provide an additional specially adapted housing grant to a disabled veteran who has already received such assistance, but whose adapted home was destroyed or substantially damaged by Hurricanes Katrina or Rita. Current law limits this benefit to one grant. Subsection (b) extends subsistence allowance from two to four months for veterans who are participating in a rehabilitation program intended to make them employable and were affected by Hurricanes Katrina or Rita. Subsection (c) provides an exception to the 2500 annual cap on new independent living cases in the Vocational Rehabilitation & Employment (VR&E) Program in the case of certain severely disabled veterans who have been determined by the Secretary to have been displaced or otherwise adversely affected by Hurricanes Katrina or Rita. Subsection (d) authorizes the Secretary to provide an additional grant for adaptive equipment for vehicles to a veteran whose vehicle was destroyed or substantially damaged by Hurricanes Katrina or Rita. Current law limits this benefit to ``one automobile or other conveyance''. ARMY CORPS OF ENGINEERS--CIVIL WORKS CONSTRUCTION, GENERAL For additional amounts for ``Construction, General'' to rehabilitate and repair Corps projects related to the consequences of Hurricanes Katrina, Rita, and Ophelia, $42,300,000, to remain available until expended; and in addition, for a program of activities, subject to the approval of the Secretary of the Army, to benefit the Gulf coastal ecosystem while helping to reduce the risk of storm damage to the greater New Orleans metropolitan area, including but not limited to the study, design, and implementation of measures that involve the nourishment, rebuilding, protection, or creation of coastal wetlands, or otherwise benefit the coastal ecosystem, $250,000,000, to remain available until expended: Provided, That this amount is available to pay for 100 percent of the costs of this program expended during fiscal years 2006 and 2007, and for 50 percent of the costs expended thereafter, the remainder to be paid by non-Federal interests: Provided further, That Congress designates these amounts as an emergency requirement for these specific purposes. This request would provide an additional $42.3 million to the Army Corps of Engineers to repair flood and storm damage reduction, commercial navigation and other projects damaged by Hurricanes Katrina, Ophelia and Rita. The request also includes $250 million for Corps efforts that would both benefit the Gulf coastal ecosystem and help to restore storm protection to the greater New Orleans metropolitan area. Coastal wetlands provide a natural buffer that can soften the impacts of some storms. As they erode, the people and infrastructure of the coastal region become more exposed and at risk. Therefore, this proposed funding is part of a balanced approach to reducing the risk of loss of life and damage to property from future storms. The appropriation of these funds would not be tied to any specific coastal ecosystem projects. They would be available, for example, for activities that could be pursued within the next six months, such as evaluating the option of closing the Mississippi River Gulf Outlet and restoring areas damaged by it, diverting Mississippi River water to nourish and rebuild eroding wetlands, and taking steps to shore up barrier islands, leading to the protection and restoration of natural systems. The Corps would pay all expenditures made through the end of fiscal year 2007; a 50 percent non-Federal cost-share would apply thereafter. ------ ARMY CORPS OF ENGINEERS--CIVIL WORKS OPERATION AND MAINTENANCE For an additional amount for ``Operation and Maintenance'' to dredge navigation channels and repair other Corps projects related to the consequences of Hurricanes Katrina, Rita, and Ophelia, $194,600,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide an additional $194.6 million to the Army Corps of Engineers to restore navigation locks and channels and other projects that the Corps is authorized to maintain in states affected by Hurricane Katrina, Ophelia and Rita. The Corps would use these funds to dredge navigation channels and harbors back to their operating depths existing prior to Hurricane Katrina, and to repair flood damage reduction and other projects. ------ ARMY CORPS OF ENGINEERS--CIVIL WORKS FLOOD CONTROL, MISSISSIPPI RIVER AND TRIBUTARIES, ARKANSAS, ILLINOIS, KENTUCKY, LOUISIANA, MISSISSIPPI, MISSOURI, AND TENNESSEE For an additional amount for ``Flood Control, Mississippi River and Tributaries, Arkansas, Illinois, Kentucky, Louisiana, Mississippi, Missouri, and Tennessee'' to cover the additional costs of mat laying and other repairs to the Mississippi River channel and associated levee repairs related to the consequences of Hurricanes Katrina and Rita, $100,000,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide $100 million to the Army Corps of Engineers. Hurricanes Katrina and Rita caused extensive damage to the levee system, dikes and channel training works. The storms also raised water levels for a prolonged period, which added to the costs of scheduled mat laying operations. The Corps would use these funds to repair levees, remove hazards to navigation, cover the increased costs of mat laying operations, repair the damaged training works including dikes, and repair damaged levees to provide protection from riverine flooding. ------ ARMY CORPS OF ENGINEERS--CIVIL WORKS FLOOD CONTROL AND COASTAL EMERGENCIES For an additional amount for ``Flood Control and Coastal Emergencies'' as authorized by section 5 of the Flood Control Act of August 18, 1941, as amended (33 USC 701n), for emergency response to and recovery from coastal storm damages and flooding related to the consequences of Hurricanes Katrina, Rita, and Ophelia, $998,000,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide $998 million for the Flood Control and Coastal Emergencies (FCCE) amount of the Army Corps of Engineers in order to continue repairs to flood and storm damage reduction projects in States affected by Hurricanes Katrina, Ophelia and Rita. The request includes $153 million to reimburse projects in other accounts for which funds were transferred to the FCCE account to meet emergency needs in the affected area. ------ ARMY CORPS OF ENGINEERS--CIVIL WORKS GENERAL INVESTIGATIONS For an additional amount for ``General Investigations'' to expedite a study of flood and storm damage reduction related to the consequences of Hurricane Katrina, $4,600,000, to remain available until expended: Provided, That Congress designates this amount as an emergency requirement for this specific purpose. This request would provide an additional $4.6 million to the Army Corps of Engineers to conduct an expedited study to determine the best way to reduce the risk of future flood and storm damages in the greater New Orleans metropolitan area. ------ OTHER DEFENSE--CIVIL PROGRAMS Trust Funds ARMED FORCES RETIREMENT HOME For payment to the ``Armed Forces Retirement Home'' for necessary expenses related to the consequences of Hurricane Katrina, $20,800,000, to remain available until expended: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. More than 400 residents of the Armed Forces Retirement Home (AFRH) in Gulfport, Mississippi were temporarily relocated to the AFRH Washington, D.C. home when the existing facility on the Gulf Coast was inundated with saltwater and debris. The previous Katrina supplemental provided $6 million for clean-up and relocation costs. This request for an additional $20.8 million would cover the accommodation and living costs of the more than 400 Gulfport residents in the Washington, D.C. facility. ------ ENVIRONMENTAL PROTECTION AGENCY LEAKING UNDERGROUND STORAGE TANK PROGRAM For an additional amount for ``Leaking Underground Storage Tank Program,'' and not to exceed $85,000 per project, $15,000,000, to remain available until expended, for the necessary expenses related to the consequences of Hurricanes Katrina and Rita in Mississippi, Louisiana, Texas, and Alabama: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would address the most immediate underground storage tank needs in areas affected by Hurricanes Katrina and Rita. This funding would enable site assessments of leaking tanks to immediately identify and initiate the appropriate corrective actions. ------ GENERAL SERVICES ADMINISTRATION FEDERAL BUILDINGS FUND For an additional amount for ``Federal Buildings Fund,'' $75,000,000, to remain available until expended from the General Fund and to remain available until expended, for necessary expenses related to the consequences of Hurricanes Katrina and Rita, of which $15,000,000 is for building operations and $60,000,000 is for repair and alterations: Provided, That notwithstanding 40 U.S.C. 3307, the Administrator of General Services is authorized to proceed with repairs and alterations for those facilities: Provided further, That the Congress designates the amounts provided herein as emergency requirements for these specific purposes. Building Operations This $15 million request would provide for emergency activities in support of cleaning, assessing damage and repairing Federal buildings and United States Courthouses damaged in the wake of Hurricanes Katrina and Rita. This request includes the unplanned costs for equipment and additional professional and nonprofessional contract staffing to support GSA personnel in the field with damage assessment, recovery efforts and facilities operations and maintenance, debris removal and clean-up activities. Repair and Alterations This $60 million request would provide for the short and long-term repair and alternations of the buildings impacted by Hurricanes Katrina and Rita. Funding will provide for the short and long-term repairs and alterations for affected buildings as described below: Building name and locations: Courthouse--Mobile, AL, Federal Building--Mobile, AL, Federal Building/Courthouse-- Hattiesburg, MS, Post Office/Courthouse--Jackson, MS, McCoy Federal Building--Jackson, MS, Federal Building/Courthouse-- Gulfport, MS, Courthouse Annex--Gulfport, MS, Gulfport Mechanical Building--Gulfport, MS, U.S. Courthouse--Pensacola, FL, Customs House--New Orleans, LA, FE Hebert Federal Building--New Orleans, LA, JM Wisdom Courthouse, Hale Boggs Federal Building--Courthouse, Border Patrol Sector Headquarters (multiple buildings), New Orleans Post Office (leased)--New Orleans, LA, and Harahan Deport (three buildings)--Harahan, LA. NATIONAL AERONAUTICS AND SPACE ADMINISTRATION EXPLORATION CAPABILITIES For an additional amount for ``Exploration Capabilities,'' $324,800,000, to remain available until expended, for necessary expenses related to the consequences of Hurricane Katrina: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide $324.8 million to support the National Aeronautics and Space Administration's (NASA) Hurricane Katrina response and recovery needs through at least May 31, 2006. Two NASA facilities sustained significant damage: Stennis Space Center in Mississippi (NASA's primary rocket propulsion testing site) and the Michoud Assembly Facility in New Orleans (manufacturing site for the Space Shuttle external tanks). The request funds will be used to meet recovery needs at both centers including: repair and replacement of real property, Space Shuttle external tanks and external tank support equipment, and communications and information technology infrastructure; environmental remediation; emergency operations (diesel fuel for power generators, debris removal, etc.); and satellite and aircraft imagery for evaluation of hurricane damage. ------ SMALL BUSINESS ADMINISTRATION OFFICE OF THE INSPECTOR GENERAL For an additional amount for ``Office of the Inspector General'' for necessary expenses related to the consequences of Hurricanes Katrina and Rita, $5,000,000, to remain available until expended: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. The Office of Inspector General will conduct audits, reviews, and investigations of the proper use of funds provided by the Small Business Administration to the victims of Hurricanes Katrina and Rita, and conduct activities to promote economy and efficiency in disaster-related operations and prevent and detect fraud, waste, and abuse in disaster-related activities. ------ SMALL BUSINESS ADMINISTRATION DISASTER LOAN PROGRAM For an additional amount for the ``Disaster Loan Program'' authorized by section 7(b) of the Small Business Act, for necessary expenses related to Hurricane Katrina and other natural disasters, $277,000,000, to remain available until expended. In addition, for administrative expenses to carry out the direct loan program authorized by section 7(b), $189,000,000, to remain available until expended, which may be transferred to and merged with ``Salaries and Expenses'': Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. The Disaster Loan program provides funds to homeowners, renters, and businesses to cover uninsured recovery costs related to natural disasters. The program also provides Economic Injury Disaster Loans for the working capital needs of business affected by disasters. The supplemental funds will provide the program with resources to respond to the recent major hurricanes and other near term-disaster events. ------ JUDICIAL BRANCH Courts of Appeals, District Courts, and Other Judicial Services SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses,'' Courts of Appeals, District Courts, and Other Judicial Services, $65,596,000, to remain available until expended, for necessary expenses related to the consequences of Hurricanes Katrina and Rita: Provided, That notwithstanding section 302 of division B of Public Law 108-477, such sums shall be available for transfer to accounts within the Judiciary subject to section 605 of said Act: Provided, That the Congress designates the amounts provided herein as an emergency requirement for this specific purpose. This request would provide (1) funding to reimburse all judges, court staff and federal public defenders staff who are on temporary duty assignment and their dependents for up to six months as a result of Hurricane Katrina, (2) funding to reimburse all judges and court staff who are on temporary duty assignment for up to two months as a result of Hurricane Rita, (3) funding for furniture, equipment and security in the temporary locations, and (4) funding to replace furniture and equipment in the court locations impacted by Hurricane Katrina and Hurricane Rita. ------ GOVERNMENT-WIDE GENERAL PROVISIONS Sec. __. From funds available in fiscal year 2006, any agency or department may transfer amounts between or within the accounts of such agency or department, for the purpose of meeting an emergency requirement in response to Hurricane Katrina: Provided, That such authority to transfer may not be used unless for higher priority items than those for which originally appropriated and in no case where the item for which funds are requested has been denied by Law: Provided further, That amounts so transferred shall be available only for authorized activities to respond to Hurricane Katrina: Provided further, That the head of each agency or department exercising this authority shall notify the Congress within 15 days of all transfers made pursuant to this authority. This proposal provides authority for any Federal agency or department to transfer funding currently available to address emergency needs related to Hurricane Katrina to assist agencies that plan to absorb certain hurricane response and recovery costs. The use of this authority is limited to higher priority items and requires notification to the Congress. ------ DEPARTMENT OF HOMELAND SECURITY Federal Emergency Management Agency DISASTER RELIEF FUND Of the funds appropriated under this heading in Public Law 109-62, $17,130,000,000 are canceled: Provided, That the budgetary effects shall be treated as an emergency requirement. This request would reallocate $17.1 billion made available by Public Law 109-62 to cover immediate needs for Hurricane Katrina response and recovery. Sufficient funds remain available within the Disaster Relief Fund to continue supporting immediate Hurricane Katrina recovery needs and response efforts for areas affected by Hurricane Wilma and potential future disasters. The proviso to treat the cancellation as an emergency requirement is intended to ensure that it is only scored as an offset to the additional emergency funding provided in this bill and not used to offset regular discretionary appropriations.
