Dear Mr. Speaker: On May 15th, I outlined to the Nation a comprehensive immigration reform initiative with five objectives. As part of my first objective to secure our Nation's borders, I ask the Congress to consider the enclosed requests for an additional $1.9 billion for the Departments of Defense, Justice, and Homeland Security, which is in addition to supplemental funding requested on February 16th for the Global War on Terror and the consequences of Hurricane Katrina. This additional amount is offset by a $1.9 billion reduction in the amount requested on February 16th for the Department of Defense. The revised request for the Department of Homeland Security will support my Administration's commitment to gain full control of the borders through the deployment of additional Border Patrol agents, infrastructure, and technology (such as hundreds of miles of new roads, vehicle barriers, tactical communications, and aerial surveillance). The request for additional resources, coupled with additional legal authority from the Congress, will end the practice of catch and release along our southern border once and for all by increasing detention, transportation, and removal capabilities. The revised request for the Department of Defense will support the deployment, in coordination with the Governors, of up to 6,000 National Guard members to the southern border. There, they will assist the Border Patrol by operating surveillance systems, building infrastructure, analyzing intelligence, and providing training until new Border Patrol agents and technologies come online. The request increases funding for training and other assistance for State and local authorities to support the Border Patrol on targeted enforcement missions. The request for the Department of Justice will provide additional resources for the prosecution and adjudication of illegal immigration cases. I designate these proposals in the amounts requested herein as an emergency requirement. I urge the Congress to act expeditiously to address the security needs along the Nation's borders. The details of these requests are set forth in the enclosed letter from the Acting Director of the Office of Management and Budget. Sincerely, George W. Bush. To implement your objective to secure the Nation's borders as part of your comprehensive immigration initiative, I submit for your consideration revised supplemental proposals for the Departments of Defense (DOD), Homeland Security (DHS), and Justice (DOJ). The original requests were transmitted to the Congress on February 16th. The proposed increase, which totals $1.9 billion, supports your commitment to increase the number of Border Patrol agents, end catch and release, assist State and local law enforcement, augment immigration enforcement along the border, and temporarily use the National Guard to assist DHS in securing the southern border. This border security initiative is fully offset through reductions in amounts previously requested for DOD. I recommend that you designate the proposals contained in this transmittal as an emergency requirement. As described below and in more detail in the enclosures, the requests include the following: Department of Defense
$756 million to place up to 6,000 National Guard personnel on the border through next year to operate surveillance systems, analyze intelligence, install fences and vehicle barriers, build patrol roads, and provide training. Department of Homeland Security $410 million for Customs and Border Protection (CBP) salaries and expenses to hire 1,000 Border Patrol Agents and the related support costs, including contract personnel; replace Border Patrol vehicles; support Secure Border Initiative integration efforts; and increase capacity at the Border Patrol Academy in Artesia, New Mexico. When combined with funds in the FY 2007 Budget and planned for subsequent budgets, this will fulfill your commitment to add 6,000 Border Patrol agents by the end of 2008, doubling the size of the Border Patrol during your presidency. $95 million for CBP's Air and Marine Interdiction account to purchase Unmanned Aerial Vehicles and helicopters. $300 million for CBP construction to provide resources to add vehicle barriers, all-weather patrol roads, and permanent lighting and fencing along the border. The funding also will allow for the expansion and investment needed to accommodate the growth in the Border Patrol agent workforce. $327 million for Immigration and Customs Enforcement (ICE) for 4,000 additional detention beds to support the Administration's goal to end catch and release along the southern border; for removal and transportation costs associated with these detention beds; for Fugitive Operations teams and other detention and removal personnel; and for the Alternatives to Detention program. Included in this request is $50 million for the 287(g) program, which will enhance partnerships between ICE and State and local law enforcement as newly trained and certified officers join immigration and border security task forces. The expanded participation will increase the apprehension, prosecution, and removal of criminal aliens and alien smuggling rings at the southern border and throughout the country. $25 million for the Federal Law Enforcement Training Center to increase training capacity for additional Border Patrol Agents. $15 million for Operation Stonegarden initiatives in southwest border States, including measures that increase border security in direct coordination with Customs and Border Protection personnel. These grants will enable State, local, and tribal law enforcement personnel to increase their patrol presence at the border; provide additional traffic control support at the border and at border patrol traffic checkpoints; and enhance their participation in the Integrated Border Enforcement Teams. This is in addition to previously appropriated funds for the Law Enforcement Terrorism Prevention Program (LETPP). Department of Justice $9 million for DOJ's Executive Office for Immigration Review to hire new administrative law judges and technical, clerical, and translator support to address the anticipated impact of enhanced enforcement efforts along the southern border. $9 million for the Civil Division's Office of Immigration Litigation to hire additional immigration attorneys as well as associated technical and clerical support. The additional positions will support the timely disposition of current and future cases. $2 million for the United States Attorneys to support enhanced border enforcement efforts along the border. Offsets The request is fully offset through reductions in the amount previously requested for the Department of Defense on February 16, 2006. The attached supplemental language reflects these reductions to that original request. These offsets come primarily from defense accounts for procurement items that can be deferred until later. There are no proposed reductions that would impact personnel or operational activities necessary for the War on Terror. Many of these offsets are similar to ones already identified by Congress. I have reviewed these proposals and am satisfied that they are necessary at this time. Therefore, I join the Secretaries of Defense and Homeland Security, and the Attorney General in recommending that you transmit the proposals to the Congress. Revised Request DEPARTMENT OF DEFENSE Operation and Maintenance OPERATION AND MAINTENANCE, DEFENSE-WIDE For an additional amount for ``Operation and Maintenance, Defense-Wide'', $4,290,929,000, of which-- (1) not to exceed $25,000,000 may be used for the Combatant Commander Initiative Fund, to be used in support of Operation Iraqi Freedom and Operation Enduring Freedom; (2) not to exceed $1,500,000,000 to remain available until expended, may be used for payments to reimburse Pakistan, Jordan, and other key cooperating nations, for logistical, military, and other support provided, or to be provided, to United States military operations, notwithstanding any other provision of law: Provided, That such payments may be made in such amounts as the Secretary of Defense, with the concurrence of the Secretary of State, and in consultation with the Director of the Office of Management and Budget, may determine, in his discretion, based on documentation determined by the Secretary of Defense to adequately account for the support provided, and such determination is final and conclusive upon the accounting officers of the United States, and 15 days following notification to the appropriate congressional committees: Provided further, That the Secretary of Defense shall provide Quarterly reports to the congressional defense committees on the use of funds provided in this paragraph; (3) not to exceed $44,500,000 for Cooperative Threat Reduction; and (4) not to exceed $756,000,000 for emergency National Guard support to the Department of Homeland Security, including operating surveillance systems, analyzing intelligence, installing fences and vehicle barriers, building patrol roads, and providing training, to remain available until September 30, 2007: Provided, That the Secretary of Defense may transfer these funds to appropriations for military personnel, operation and maintenance, and procurement to be available for the same purposes as the appropriation or fund to which transferred: Provided further, That this transfer authority is in addition to any other transfer authority available to the Department of Defense: Provided further, That upon a determination that all or part of the funds transferred from this appropriation are not necessary for purposes provided herein, such amounts may be transferred back to this appropriation, to be merged with and available for the same purposes and for the time period provided under this heading: Provided further, That the Secretary of Defense shall, not more than five days after making transfers from this appropriation, notify the congressional defense committees in writing of any such transfer. This proposal would provide $756 million to support National Guard deployments in support of U.S. border control efforts. In coordination with the governors, rotations of up to 6,000 National Guard members will be deployed to the Nation's southern border. The Guard units will assist in border security efforts through tasks such as: operating surveillance systems, analyzing intelligence, installing fences and vehicle barriers, building patrol roads, and providing training. However, National Guard units deployed to the border will not be involved in direct law enforcement activities; that duty will be done by the Department of Homeland Security which will remain in the lead. This initial commitment of Guard members would last for one year. After that, the number of National Guard members will be reduced as new Border Patrol agents are added and new technologies come online. At any one time, these 6,000 Guard members account for less than two percent of the total National Guard force of more than 440,000. Guard members will be deployed in two- to three-week rotations to meet this 6,000 person level. There are enough National Guard members to deploy to the Nation's border, while continuing to respond to natural disasters and fight and win the War on Terror. Military personnel will be employed consistent with applicable Federal, State, and local law. The National Guard Bureau will serve as the coordinating authority to deploy National Guard units from across the country to perform the border security mission in support of the Department of Homeland Security. The National Guard units will remain under the command and control of their respective State governors and Adjutants General. The funds are requested in the Operation and Maintenance Defense-Wide account, to be available through FY 2007. Once the operational details of the Guard deployments are worked out, the Secretary will transfer funds from this account to the proper military personnel, Operations and Maintenance, and procurement accounts for expenditure. He will notify Congress of these transfers within five days. Furthermore, $3.5 billion that was previously requested would provide support to Operation Iraqi Freedom and Operation Enduring Freedom. This request includes funds for: operations; transportation; supplies and equipment; depot maintenance; and command, control, and intelligence capabilities in part for the Special Operations Command. It would also fund the communication backbone and continuing support for voice, video and data systems management, transmission and satellite services. In addition, this request would finance continuing support for contract audit, contract management, media, military tribunals, family support counseling, and critical infrastructure protection. This request includes $95 million to support the lift and sustainment costs of Coalition partners. The additional funding authorized for the Combatant Commander Initiative Fund supports unforeseen low-cost, high- benefit initiatives that enhance joint warfighting capabilities in support of Operation Iraqi Freedom and Operation Enduring Freedom. The request would also fund payments to key cooperating nations (e.g., Pakistan, Jordan) and Coalition countries providing logistical, military, or other support to U.S. military operations in support of Operation Iraqi Freedom and Operation Enduring Freedom. Such support includes transportation into the theater, providing supplies to Coalition forces in the theater, and helping Coalition forces with communication support. In addition, this request would provide $44.5 million to fund urgent activities to secure nuclear warheads at storage sites in Russia, as part of a global strategy to prevent terrorist organizations from gaining access to nuclear weapons materials. These funds would support the Cooperative Threat Reduction program's efforts to prevent proliferation by ensuring the security and safety of nuclear weapons during storage, pending their final dismantlement and demilitarization. The requested funding supports the accelerated schedule for these activities agreed to by Presidents Bush and Putin at the G-8 Summit in Bratislava in February, 2005. ------ DEPARTMENT OF HOMELAND SECURITY Customs and Border Protection SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses'', $410,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. These funds will provide the resources to hire 1,000 Border Patrol Agents and the related support costs, including contract personnel; replace Border Patrols vehicles; support Secure Border Initiative integration efforts; and increase capacity at the Border Patrol Academy in Artesia, New Mexico. When combined with funds in the FY 2007 and subsequent budgets, this will add 6,000 Border Patrol agents by the end of 2008, doubling the size of the Border Patrol. ------ DEPARTMENT OF HOMELAND SECURITY Customs and Border Protection AIR AND MARINE INTERDICTION, OPERATIONS, MAINTENANCE, AND PROCUREMENT For an additional amount for ``Air and Marine Interdiction, Operations, Maintenance, and Procurement'', $95,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. These funds will provide the resources to purchase two Unmanned Aerial Vehic1es and 13 additional helicopters. ------ Revised Request DEPARTMENT OF HOMELAND SECURITY Customs and Border Protection CONSTRUCTION For an additional amount for ``Construction'', $316,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. This request adds $300 million to the pending supplemental request for this account. The additional funds will provide the resources to add 256 miles of vehicle barriers, 359 miles of all weather patrol roads, and additional lighting and fencing along the border. The funding will also allow for the expansion of Border Patrol facilities needed to accommodate the growth in the Border Patrol agent workforce. The remaining $16 million will be used for build-out costs; replacement items, including the laboratory and seizure vault; and other tenant improvements to rebuild Customs and Border Protection structures in New Orleans, Louisiana, as previously requested. ------ DEPARTMENT OF HOMELAND SECURITY Immigration and Customs Enforcement SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses'', $327,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. This request will provide the resources for 4,000 additional detention beds to support the Administration's goal to end catch and release along the southern border; for removal and transportation costs associated with these detention beds; for improving partnerships with State and local law enforcement in the enforcement of immigration laws; for hiring for Fugitive Operations teams and other detention and removal personnel; and for the Alternatives to Detention program. ------ DEPARTMENT OF HOMELAND SECURITY Federal Law Enforcement Training Center CONSTRUCTION For an additional amount for ``Salaries and Expenses'', $25,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. These funds would provide $25 million to increase training capacity for additional Border Patrol Agents. These resources would be used to increase the number of classes the Federal Law Enforcement Training Center is able to provide, and to increase physical capacity as necessary. ------ DEPARTMENT OF HOMELAND SECURITY Preparedness STATE AND LOCAL PROGRAMS For an additional amount for ``State and Local Programs'', for discretionary grants as determined by the Secretary, $15,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. These funds will provide for grants to support the Operation Stonegarden initiative in selected States, including measures that increase border security in direct coordination with Customs and Border Protection personnel. Grants will enable State, local, and Tribal law enforcement personnel to increase their patrol presence at the border; provide additional traffic control support at the border and at border patrol traffic checkpoints; and enhance their participation in the Integrated Border Enforcement Teams. Funding shall be allocated to border States at the discretion of the Secretary for maximum effectiveness, and there is no minimum funding level for any State. No funds would be obligated or drawn down in support of these activities without Department of Homeland Security (DHS) approval of operational support plans. State, local, and Tribal law enforcement agencies could not use this funding to supplant routine patrol and law enforcement operations or activities in order to perform other activities not directly related to providing an enhanced law enforcement support of Federal border enforcement. No funding would be used for DHS Management and Administration costs, and States could use no more than three percent for management and administration. ------ DEPARTMENT OF JUSTICE General Administration SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses'', $9,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. These funds would provide $9 million for Administrative Review and Appeals' Executive Office For Immigration Review for new administrative law judges and technical, clerical and translator support to address the anticipated impact of Operation Streamline and other enhanced enforcement efforts along the southern border. ------ DEPARTMENT OF JUSTICE General Legal Activities SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses'', $9,000,000, to remain available until September 30, 2007: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. These funds would provide the Civil Division's Office of Immigration Litigation (OIL) with $9 million for additional immigration attorneys, as well as associated technical and clerical support. The additional positions will help manage the increased caseload of OIL attorneys along the southern border and will support the timely disposition of current and future cases. ------ Revised Request DEPARTMENT OF JUSTICE United States Attorneys SALARIES AND EXPENSES For an additional amount for ``Salaries and Expenses'', $11,700,000, to remain available until September 30, 2007, of which $9,700,000 is for hurricane-related prosecution and investigation expenses: Provided, That Congress designates this amount as an emergency requirement for these specific purposes. The proposal would provide $2 million for new Assistant United States Attorneys to support enhanced border enforcement efforts along the southern border. Additional U.S. Attorneys are required to ensure that appropriate cases can be prosecuted and that caseloads for U.S. Attorneys remain at manageable levels. In addition, the proposal would provide up to $9.7 million to support the prosecution and investigation of cases stemming from hurricanes in the Gulf Coast region, as previously requested. The resources will be used for the costs associated with significant additional caseload relating to the hurricanes and the aftermath. ------ Revised Request DEPARTMENT OF DEFENSE Operation and Maintenance OPERATION AND MAINTENANCE, NAVY For an additional amount for ``Operation and Maintenance, Navy'', $2,791,300,000: Provided, That $75,020,000 shall be transferred to the Coast Guard ``Operating Expenses'' account for reimbursement for activities in support of activities requested by the Navy. This request would provide $2.8 billion to fund Navy activities in support of Operation Iraqi Freedom and Operation Enduring Freedom. This funding would support the Navy's efforts to bring peace and stability to Iraq and Afghanistan. This proposal includes necessary resources to cover costs associated with support for Active and mobilized Reserve personnel, including travel and per diem, and costs associated with operations, such as incremental flying hours, ship steaming days, contractor logistics support, fuel purchases, base support, depot maintenance, and over-ocean transportation. The request also includes a reimbursement of $20 million, which is the Navy's share of the reprogramming to finance DOD operations associated with Pakistan earthquake relief. The request provides funds for the Coast Guard forces to continue to provide port security and law enforcement capabilities, as requested by the Department of Defense Combatant Commander. ------ Revised Request DEPARTMENT OF DEFENSE Operation and Maintenance OPERATION AND MAINTENANCE, MARINE CORPS For an additional amount for ``Operation and Maintenance, Marine Corps'', $ 1,622,111,000. This request would provide $1.6 billion to fund Marine Corps activities in support of Operation Iraqi Freedom and Operation Enduring Freedom. This funding would support the Marine Corps' efforts to bring peace and stability to Iraq and Afghanistan. This proposal includes necessary resources to cover costs associated with support for Active and mobilized Reserve personnel, including travel and per diem, and costs associated with operations, such as incremental ground operations, logistics support, fuel purchases, base support, depot maintenance, and over-ocean transportation. ------ Revised Request DEPARTMENT OF DEFENSE Procurement AIRCRAFT PROCUREMENT, ARMY For an additional amount for ``Aircraft Procurement, Army'', $345,000,000, to remain available until September 30, 2008. This request would provide $345 million to fund procurement of AH-64 aircraft destroyed in the Global War on Terror. ------ Revised Request DEPARTMENT OF DEFENSE Procurement PROCUREMENT OF WEAPONS AND TRACKED COMBAT VEHICLES, ARMY For an additional amount for ``Procurement of Weapons and Tracked Combat Vehicles, Army'', $1,127,351,000, to remain available until September 30, 2008. This request would provide $1.1 billion to: execute various soldier protection initiatives to improve armored vehicle survivability, including reactive armor tiles for Bradley personnel carriers, Common Remotely Operated Weapons System (CROWS) units to minimize exposure of crews to enemy fire, Counter-Rocket Artillery Mortar (CRAM) systems to protect urban environments from munitions fire, and other measures; refurbish tracked vehicles that experienced major wear and tear from use in Iraq and Afghanistan, primarily Bradley support vehicles and armored recovery vehicles; and support Army Modularity by funding Towed Howitzers, training systems, and Stryker vehicles. ------ Revised Request DEPARTMENT OF DEFENSE Procurement OTHER PROCUREMENT, ARMY For an additional amount for ``Other Procurement, Army'', $6,789,791,000, to remain available until September 30, 2008. This request would provide $6.8 billion to: refurbish or replace a large number of wheeled vehicles, including High Mobility Multi-Purpose Wheeled Vehicles, medium and heavy trucks, and various trailers which experienced high levels or wear and tear during operations in Iraq and Afghanistan; procure next-generation jammers and other new technologies to defeat improvised explosive devices; acquire tactical radios, Global Command and Control System elements, battle management systems, and C4I equipment; provide Armored Security Vehicles to provide better protection for convoy operations, add-on armor for trucks, night vision devices, and other force protection needs; and replace generators, water systems, the Forward Repair System, various equipment spares, and various equipment based on operational needs. ------ Revised Request DEPARTMENT OF DEFENSE Procurement AIRCRAFT PROCUREMENT, NAVY For an additional amount for ``Aircraft Procurement, Navy'', $151,769,000, to remain available until September 30, 2008. This request would fund items such as F/A-18 litening pods, AV-8B upgrades, aircraft fuel tanks, aircraft air foils, as well as various other critical components to support operational needs. ------ Revised Request DEPARTMENT OF DEFENSE Procurement WEAPONS PROCUREMENT, NAVY For an additional amount for ``Weapons Procurement, Navy'', $55,200,000, to remain available until September 30, 2008. This request would provide $55.2 million to fund the replacement of Hellfire missiles. ------ Revised Request DEPARTMENT OF DEFENSE Procurement PROCUREMENT OF AMMUNITION, NAVY AND MARINE CORPS For an additional amount for ``Procurement of Ammunition, Navy and Marine Corps'', $323,256,000, to remain available until September 30, 2008. This request would provide $323 million to fund the replacement of conventional ammunition for the Navy and Marine Corps that was used in Operation Iraqi Freedom and Operation Enduring Freedom. ------ Revised Request DEPARTMENT OF DEFENSE Procurement OTHER PROCUREMENT, NAVY For an additional amount for ``Other Procurement, Navy'', $54,640,000, to remain available until September 30, 2008. This request would provide $55 million to fund procurement of items such as the Navy's distributed common ground system, the replacement of up-armored High Mobility Multi-Purpose Wheeled Vehicles and other vehicles, and various other items used in Operation Iraqi Freedom based on operational needs. ------ Revised Request DEPARTMENT OF DEFENSE Procurement PROCUREMENT, MARINE CORPS For an additional amount for ``Procurement, Marine Corps'', $2,577,467,000, to remain available until September 30, 2008. This request would provide $2.6 billion for: refurbishment and replacement of worn out vehicles and equipment, including Light Armored Vehicles, High Mobility Multi-Purpose Wheeled Vehicles (HMMWVs), various trucks, weapons and other equipment; procurement of various force protection equipment, including armored vehicles to improve convoy security, add-on armor kits for HMMWVs and trucks to enhance crew protections, tactical radios, small arms, and night vision equipment; and various items to support Marine Corps force structure changes to allow for sustained counter- insurgency operations. ------ Revised Request DEPARTMENT OF DEFENSE Procurement AIRCRAFT PROCUREMENT, AIR FORCE For an additional amount for ``Aircraft Procurement, Air Force'', $347,135,000, to remain available until September 30, 2008. This request would provide $347.1 million to fund the replacement of MC-130H aircraft, Predator unmanned aerial vehicles, C-17 spares, and various other items based on Global War on Terror operational needs. ------ Revised Request DEPARTMENT OF DEFENSE Procurement OTHER PROCUREMENT, AIR FORCE For an additional amount for ``Other Procurement, Air Force'', $1,476,991,000, to remain available until September 30, 2008. This request would provide $1.5 billion to fund communications equipment, up-armored High Mobility Multi- Purpose Wheeled Vehicles, mine clearing equipment, and various other items based on Global War on Terror operational needs. ------ Revised Request DEPARTMENT OF DEFENSE Research, Development, Test, and Evaluation RESEARCH, DEVELOPMENT, TEST, AND EVALUATION, ARMY For an additional amount for ``Research, Development, Test, and Evaluation, Army'', $402,177,000, to remain available until September 30, 2007. This request would provide $402.2 million to fund the development of various efforts to support Army modularity efforts, as well as measures to combat the proliferation and use of improvised explosive devices. ------ Revised Request DEPARTMENT OF DEFENSE Research, Development, Test, and Evaluation RESEARCH, DEVELOPMENT, TEST, AND EVALUATION, NAVY For an additional amount for ``Research, Development, Test, and Evaluation, Navy'', $124,845,000, to remain available until September 30, 2007.
