Dear Madam Speaker: I ask the Congress to consider the enclosed amendments to my FY 2009 Budget that provide the necessary resources for ongoing military and intelligence operations, as well as foreign assistance activities in support of Operation Iraqi Freedom and Operation Enduring Freedom. They also provide the necessary resources for selected other international activities that advance our national security, including food assistance to address the global food crisis. These amendments distribute by account $70 billion of discretionary budget authority included as an allowance in my FY 2009 Budget for the Global War on Terror. This amount is already factored into the FY 2009 Budget projections and would not increase the deficit. I hereby designate the specific proposals in the amounts requested herein as emergency requirements. This request represents urgent and essential requirements. Submitted for your consideration are amendments to your FY 2009 Budget that would provide necessary resources for ongoing military and intelligence operations, as well as civilian diplomatic efforts and foreign assistance activities in support of Operation Iraqi Freedom and Operation Enduring Freedom. They would also provide necessary resources for selected other international activities that advance our national security, including urgent food aid. These amendments distribute by account $70 billion of discretionary budget authority included as an allowance in your FY 2009 Budget for the Global War on Terror (GWOT). The amendments, therefore, do not affect the total discretionary budget authority proposed in your FY 2009 Budget. This $70 billion request and all prior war funding are included in your Administration's deficit projections. Of the amounts to be distributed, $66 billion is for the Department of Defense and classified activities, and $4 billion is for international functions. The major categories of funding are highlighted below. Military and intelligence operations
$45.1 billion to fund combat operations and related activities in support of Operation Iraqi Freedom (OIF) and Operation Enduring Freedom (OEF). $3.7 billion to expand the size of the Afghan Security Forces and enhance their capacity to conduct counterinsurgency operations independent of U.S. assistance. $2.0 billion to sustain efforts to enhance the Iraqi Security Forces' capacity to conduct independent counterinsurgency operations. $1.7 billion for the Commander's Emergency Response Program in Iraq and Afghanistan to enable commanders to address local populations' urgent needs and gain support in the fight against insurgents. $400 million to maintain and enhance medical and rehabilitation services associated with traumatic brain injury and psychological health issues for our Wounded Warriors returning from Iraq and Afghanistan. $3.0 billion for classified activities. $2.2 billion for projected increased fuel costs. $900 million to reimburse partners for logistical, military, and other support in the GWOT. Equipment and force structure $3.0 billion to develop anti-improvised explosive device (IED) technologies and provide pre-deployment training in methods to counter all forms of IEDs. $2.6 billion to transport and maintain Mine Resistant Ambush Protected vehicles in theater. $1.3 billion to fund acquisition of 28 additional Unmanned Aerial Vehicles and support systems to enhance protection of U.S. and coalition forces. $100 million for new force protection equipment in response to emerging threats in order to minimize U.S. casualties. International affairs and stabilization activities $2.5 billion for ongoing GWOT activities: --$1.4 billion for Iraq, including support for Provincial Reconstruction Teams (PRTs), Iraqi refugees and internally displaced persons (IDPs), provincial elections, security and operations, and the Office of the Inspector General. --$1.1 billion for Afghanistan, including support for democracy and governance, agriculture, development, counter- narcotics, PRTs, humanitarian activities, and security and operations. $770 million for emergency food aid and assistance to address the destabilizing effects of the global food crisis, including support for agriculture programs to increase food security. $350 million to expand stability in the Middle East, including $200 million for the West Bank, $100 million for Jordan, and $50 million for Lebanon. $193.2 million for Pakistan to fund military and economic assistance, increase diplomatic activities in the Federally Administered Tribal Areas, and expand U.S. Agency for International Development (USAID) operations. $122.9 million to support stabilization activities in Africa, including support for Kenya, Democratic Republic of the Congo, Uganda, USAID operations in Sudan, and the African Union Mission in Somalia. $35.6 million for increased diplomatic security support to several Middle East peace missions and personnel in Sudan and Somalia. $15 million to advance the six-party talks agreement to address the North Korean nuclear program. Recommendation This request fulfills known and urgent needs and I recommend that you designate the specific amendments contained in this transmittal as emergency requirements. I have carefully reviewed these proposals and am satisfied that they are necessary at this time. FY 2009 Emergency Proposals DEPARTMENT OF DEFENSE Operation and Maintenance OPERATION AND MAINTENANCE, DEFENSE-WIDE FY 2009 Budget Appendix Pages: 255-256 FY 2009 Pending Request: $26,091,864,000 Proposed Amendment: $3,193,494,000 Revised Request: $29,285,358,000 (In the appropriations language under the above heading, insert the following new paragraph immediately after the concluding period:) For an additional amount for ``Operation and Maintenance Defense-Wide,'' $3,193,494,000, of which (1) not to exceed $25,000,000 may be used for the Combatant Commander Initiative Fund, to be used in support of Operation Iraqi Freedom and Operation Enduring Freedom; (2) not to exceed $100,000,000, to remain available until expended may be used, notwithstanding any other provision of law, for the purpose of providing specialized training and procuring supplies and specialized equipment and providing such supplies and loaning such equipment on a non-reimbursable basis to coalition forces supporting United States military operations in Iraq and Afghanistan; (3) not to exceed $50,000,000 may be used, notwithstanding any other provision of law, for the purpose of providing for the redevelopment of the Iraqi industrial sector by identifying, and providing assistance to, factories and other industrial facilities that are best situated to resume operations quickly and reemploy the Iraqi workforce; and (4) not to exceed $900,000,000, to remain available until expended, may be used for payments to reimburse Pakistan, Jordan, and other key cooperating nations, for logistical military, and other support provided, or to be provided, to United States military operations relating to Iraq, Afghanistan or other aspects of combating terrorism, notwithstanding any other provision of law: Provided, That the Congress designates this amount as an emergency requirement for this specific purpose: Provided further, That reimbursement payments provided under (4) above may be made in such amounts as the Secretary of Defense, with the concurrence of the Secretary of State, and in consultation with the Director of the Office of Management and Budget may determine, in his discretion, based on documentation determined by the Secretary of Defense to adequately account for the support provided, and such determination is final and conclusive upon the accounting officers of the United States, and 15 days following notification to the appropriate congressional committees: Provided further That the Secretary of Defense shall provide quarterly reports to the congressional defense committees on the use of funds provided under (2) and (4) above. This proposal would partially fund the incremental costs for activities in support of Operation Iraqi Freedom and Operation Enduring Freedom, including classified activities. These activities encompass operations; transportation; supplies and equipment; depot maintenance; and command, control, and intelligence capabilities. This request would also fund the communication backbone and continuing support for voice, video and data systems management; transmission; and satellite services. In addition, this request would finance continuing support for contract audit; contract management; media; family support counseling; wounded, ill and injured initiatives; and critical infrastructure protection. This request includes funds to support the lift and sustainment costs of coalition partners. The additional funding authorized for the Combatant Commander Initiative Fund supports unforeseen low-cost, high- benefit initiatives that enhance joint warfighting capabilities in support of Operation Iraqi Freedom and Operation Enduring Freedom. The request would also partially fund payments to key cooperating nations (e.g., Pakistan and Jordan) and coalition countries providing logistical, military, or other support to U.S. military operations in support of Operation Iraqi Freedom and Operation Enduring Freedom, or other aspects of combating terrorism. Such support includes transportation into the theater, providing supplies to coalition forces in the theater, and helping coalition forces with communication support. The proposed language would authorize the Department of Defense (DOD) to use up to $100 million of Operation and Maintenance, Defense-wide funds to provide specialized training, supplies and equipment to coalition forces that could not deploy to or conduct their missions in Iraq and Afghanistan without such support. This authority will allow specialized pre-deployment training to ensure coalition forces are adequately prepared for deployment. Use of this authority to purchase equipment for deployments will allow the U.S. Government to retain ownership of such equipment and to rotate the equipment to follow-on replacements of coalition forces (except for those personal clothing items or other supplies not normally re-issued to follow-on rotations), thus achieving a cost savings. Furthermore, DOD can ensure that coalition forces have current and interoperable equipment, especially counter- improvised explosive device equipment, thus potentially reducing casualties for both coalition and U.S. forces. The proposed language would also provide authority of up to $50 million to continue the work being done by the Task Force to improve Business and Stability Operations in Iraq, as well as other classified activities. These activities encompass training, equipment, intelligence, infrastructure, and information operations related to the campaign against narcotics trafficking and narcotics-related terrorist activities in Afghanistan and Central Asia. This proposal would authorize a new Medical Support Fund and partially fund activities to improve the effectiveness of efforts to transition service members returning from deployment in support of the Global War on Terror who have traumatic brain injuries or psychological health issues, to a successful return to productive military service or civilian society. This proposal would provide a total of $3,666.3 million, which includes $2,084.4 million for training, equipping, sustaining, and providing infrastructure to support the Afghan Ministry of Defense forces. Also included is $1,513.6 million for training, equipping, sustaining, and providing infrastructure to support the Afghan Ministry of Interior forces. It further includes $68.3 million for associated activities, including detainee operations and counterinsurgency activities. This proposal would enable the Department to continue to protect U.S. forces by defeating improvised explosive devices (IEDs)--the enemy's weapon of choice. These funds will enable the Department to attack the IED network, defeat the devices, and train U.S. forces to defeat and disarm these weapons. The use of IEDs continues to be a significant challenging threat to U.S. and coalition forces in Iraq and Afghanistan. This request will fund action against components of the IED system, the IED makers, the trainers, and supporting infrastructures. It will enable the Department to meet joint urgent operational needs identified by the field commanders by developing and procuring the latest technologies and equipment. The request will fund efforts to improve the Department's ability to detect IEDs at greater stand-off distances; conduct research on counter-IED protective materials; and conduct research and development of systems to detect and counter-IED triggers at increasing ranges. The price of crude oil has continued to climb, and the Department projects that these higher rates will remain in effect through FY 2009. The additional funding requested will support a crude oil price of $97.19 per barrel and an average refined petroleum product of $125.35. SPECIAL TRANSFER AUTHORITY. Upon the determination of the Secretary of Defense that such action is necessary in the national interest, the Secretary may transfer between appropriations up to $4,000,000,000 of the funds made available to the Department of Defense in this Act and designated as an emergency requirement: Provided, That the Secretary shall notify the Congress promptly of each transfer made pursuant to the authority in this section: Provided further That the authority provided in this section is in addition to any other transfer authority available to the Department of Defense and is subject to the same terms and conditions as the authority provided in section 8003 of this Act. This language will provide the Department with special transfer authority to fund emerging requirements. SEC. 8060. INTELLIGENCE AUTHORITY. Funds appropriated or made available by transfer in this act may be obligated and expended notwithstanding section 504(a)(1) of the National Security Act of 1947 (50 U.S.C. 414(a)(1)). This proposed waiver is necessary in order to authorize the Department and the Intelligence Community to obligate supplemental amounts for activities funded through the National Intelligence Program. SEC. 8061. COMMANDER'S EMERGENCY RESPONSE PROGRAM (CERP) AUTHORITY. (a) Availability of Funds for CERP. From funds made available in this Act to the Department of Defense and designated as an emergency requirement, not to exceed $1,722,000,000, to remain available until December 31, 2009, may be used, notwithstanding any other provision of law, to fund the Commander's Emergency Response Program for the purpose of enabling military commanders in Iraq to respond to urgent humanitarian relief and reconstruction requirements within their areas of responsibility by carrying out programs that will immediately assist the Iraqi people, and to fund a similar program to assist the people of Afghanistan: Provided, That the Secretary of Defense may accept contributions of funds from any person, foreign government, or international organization to carry out the Commander's Emergency Response Program in Iraq or Afghanistan, and may use any funds contributed for such purpose. (b) Quarterly Reports. Not later than 45 days after the end of each fiscal year quarter (beginning with the first quarter of fiscal year 2009), the Secretary of Defense shall submit to the congressional defense committees a report regarding the source of funds and the allocation and use of funds during that quarter that were made available pursuant to the authority provided in this section or under any other provision of law for the purposes of the programs under subsection (a). Additional Commander's Emergency Response Program (CERP) authority is required to support the military commanders in winning the support of the locals and in stabilizing Iraq and Afghanistan. The CERP projects are identified by commanders working in concert with provincial and district leaders. The military commanders in the field believe that CERP is one of their most valuable weapons in securing and stabilizing the various regions/cities in Iraq. The last proviso will allow the Secretary of Defense to accept contributions from the Government of Iraq and others for the military commanders to use for CERP projects. SEC. 8062. DEFENSE COOPERATION ACCOUNT CONTRIBUTIONS TRANSFER AUTHORITY. During fiscal year 2009, the Secretary of Defense may transfer amounts in or credited to the Defense Cooperation Account, pursuant to 10 U.S.C. 2608, to such appropriations or funds of the Department of Defense as he shall determine for use consistent with the purposes for which such funds were contributed and accepted: Provided, That such amounts shall be available for the same time period as the appropriation to which transferred: Provided further, That the Secretary shall report to the Congress all transfers made pursuant to this authority. This authority will allow the Department to obligate any funds contributed by the Iraqis and others specifically for the Global War on Terror. SEC. 8063. SPECIAL COUNTER-DRUG AUTHORITY. (a) AUTHORITY TO PROVIDE SUPPORT.--Of the amount appropriated by this Act under the heading, ``Drug Interdiction and Counter-Drug Activities Defense,'' not to exceed $30,000,000 may be used for support for counter-drug activities of the Governments of Afghanistan, Kyrgyzstan, Kazakhstan, Pakistan, Tajikistan and Turkmenistan: Provided That such support shall be in addition to support provided for the counter-drug activities of such Governments under any other provision of the law. (b) TYPES OF SUPPORT.--(1) Except as specified in subsection (b)(2) of this section the support that may be provided under the authority in this section shall be limited to the types of support specified in section 1033(c)(1) of the National Defense Authorization Act for Fiscal Year 1998 (Public Law 105-85, as amended by Public Laws 106-398, 108-136, and 109-364) and conditions on the provision of support as contained in section 1033 shall apply for fiscal year 2009. (2) The Secretary of Defense may transfer vehicles, aircraft, and detection, interception, monitoring and testing equipment to said Governments for counter-drug activities. This section would add $30 million in additional Section 1033 authority in FY 2009. Current law authorizes the Department of Defense (DOD) to provide specific types of support, not to exceed $60 million annually. This authorization has enabled the Department and the U.S. Government to bolster nascent security efforts in Afghanistan and Central Asia. The requested authority increases the amount of funding DOD can spend to accommodate Afghanistan's and other Central Asia nations' acute requirements for equipment and maintenance. These countries are situated either along key drug smuggling routes or are facing an increasing threat of narcoterrorism. Enhanced interdiction capabilities for the countries listed in this legislation are critical to U.S. efforts to stem the flow of illicit drugs, and to reduce the threat of narcoterrorism to struggling democracies. SEC. 8064. LIFT AND SUSTAIN AUTHORITY FOR IRAQ AND AFGHANISTAN. Funds made available to the Department of Defense in this Act and designated as an emergency requirement may be used, notwithstanding any other provision of law, to provide supplies, services, transportation, including airlift and sealift and other logistical support to coalition forces supporting military and stability operations in Iraq and Afghanistan: Provided, That the Secretary of Defense shall provide quarterly reports to the congressional defense committees regarding support provided under this section. This section would authorize the Department of Defense (DOD) to provide airlift, sealift, and sustainment for countries supporting U.S. military operations in Iraq and Afghanistan. The DOD has used this authority, generally referred to as Lift and Sustain authority, to support willing coalition countries that otherwise could not support U.S. military operations. Smaller coalition countries do not have the financial means or the funding to transport their forces to and from the operating theater or to sustain their forces for extended deployments. Direct support from the United States is critical to enabling forces from these countries to remain in theater. Without this authority, many coalition countries will not be able to maintain their forces in U.S. military operations thus increasing the stress on U.S. forces operating in theater. SEC. 8065. EXTENSION OF FUNDS AVAILABLE FOR POST TRAUMATIC STRESS DISORDER AND TRAUMATIC BRAIN INJURY. Of the amounts provided under the heading ``Defense Health Program'' in Public Law 110-28 for the treatment of traumatic brain injury and post-traumatic stress disorder. $600,000,000 of such amounts shall be available for psychological health and traumatic brain injury: Provided, That of such amounts, $100,000,000 shall remain available until September 30, 2009. The Department needs to extend the period of availability for $100 million of the $600 million appropriated for Post- Traumatic Stress Disorder and Traumatic Brain Injury in the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 (Public Law 110- 28) to ensure funds are executed in a fiscally prudent manner. While the Department has moved aggressively to improve research, prevention, access, diagnosis, mitigation, treatment and rehabilitative care for individuals with Post-Traumatic Stress Disorder and Traumatic Brain Injury, initial ramp-up and staffing requirements have taken longer than expected due to the specialized and cutting-edge nature of these programs. To avoid further complications in the execution of these funds, the language also clarifies that the funding provided for Post- Traumatic Stress Disorder is available under the more broadly defined term of psychological health. This proposal would fund the incremental costs of $175 million for counternarcotics and rule of law programs in Afghanistan to sustain reductions in poppy cultivation and enhance public confidence and access in the justice and law enforcement sectors. The proposal also includes $50 million for the West Bank to train, equip, and garrison Palestinian Authority Security Forces. FY 2009 Emergency Proposals INTERNATIONAL ASSISTANCE PROGRAMS International Security Assistance ECONOMIC SUPPORT FUND FY 2009 Budget Appendix Page: 798 FY 2009 Pending Request: $3,153,743,000 Proposed Amendment: $1,297,700,000 Revised Request: $4,451,443,000 (In the appropriations language under the above heading insert the following new paragraph immediately after the concluding period:) For an additional amount for ``Economic Support Fund,'' $1,297,700,000, to remain available until September 30, 2010: Provided, That the Congress designates this amount as an emergency requirement for this specific purpose: Provided further, That, notwithstanding any other provision of law, of the funds appropriated under this heading, up to $15,000,000 may be made available for assistance to the Democratic Peoples Republic of Korea to support the goals of the Six Party Talks: Provided further, That with respect to the previous proviso, the Secretary of State shall, not fewer than 5 days prior to the obligation of funds from this appropriation for such purpose, notify the Committees on Appropriations of the Senate and the House of Representatives in writing of the details of any such obligation. This proposal would fund the incremental costs for activities in Afghanistan, Iraq, Pakistan, the West Bank, Jordan and North Korea. This includes $750 million to support the continuation of urgent assistance programs in Afghanistan. Of this amount, $100 million would sustain funding for alternative development programs in large poppy producing provinces; $189 million would support road and power projects; $220 million would support democracy and governance programs including support for local elections, rule of law, and civil society; $101 million would fund the continuation and expansion of agriculture and economic development programs; $125 million would continue the Local Governance and Capacity Development program at the provincial level; and $15 million would provide support for internally displaced persons (IDPs). The proposal would provide $212.8 million for Iraq, including $75 million for a new, urgent program to support upcoming provincial elections that the Iraqi government recently announced and $137.8 million for the Quick Response Fund to give our Provincial Reconstruction Team leaders the resources they need to support stability operations, accelerate provincial economic development, and provide critical employment opportunities. This proposal would also provide: $70 million for Pakistan for district elections support, good governance programs, and rural health and basic education initiatives in conflict regions outside of the Federally Administered Tribal Areas; $150 million for urgent budget support to the Palestinian Authority; $100 million for Jordan, including $60 million for support to communities that have experienced an influx of Iraqi refugees and $40 million to support economic growth, health, education, and governance programs to help Jordan cope with increasing economic pressures; and $15 million for Heavy Fuel Oil to North Korea in return for actions taken by North Korea on denuclearization. Authority is required to provide the heavy fuel oil or an equivalent value of energy or economic assistance to North Korea on an ``action-for- action'' basis in support of the Six Party Talks. This assistance is in return for actions taken by North Korea on denuclearization and would allow other programs supporting the Six Party Talks. This proposal would fund the incremental costs of military assistance for Pakistan, Lebanon, and Poland. Of the $170 million requested, $100 million is for military assistance for Pakistan to reduce terrorist and militant activity in the Afghanistan-Pakistan border region including efforts to train and equip Pakistan's Frontier Corps; $50 million is for military assistance for Lebanon to increase its ability to secure its borders and provide additional security training and equipment to the Lebanese Armed Forces; and $20 million is for military assistance for Poland to enhance its military capabilities. This proposal would provide $60 million to fund U.S. assistance to international efforts to monitor and maintain peace in Somalia and Democratic Republic of Congo. Of the $60 million, $20 million will be used to train and equip a counterterrorism brigade that will help stabilize the security situation in eastern Congo. The remaining $40 million will permit deployment of additional troops in support of the African Union Mission in Somalia (AMISOM). AMISOM troops will support efforts toward national elections and the restoration of effective governance and lasting stability. This proposal would fund the incremental costs of critical humanitarian needs. Of the $270 million requested, $225 million would address urgent humanitarian needs created by high food prices in vulnerable populations abroad, particularly in Africa, including up to $125 million for local and regional procurement of food aid abroad. The proposal includes $45 million to address urgent humanitarian needs in Iraq, such as the provision of emergency relief supplies, support for water and sanitation infrastructure, creation of safe protective spaces for women and children, and emergency health care, or to address other urgent humanitarian needs. This proposal provides $60 million for the extraordinary security, personnel, and other operational costs supporting U.S. Agency for International Development assistance to Afghanistan, Iraq, Pakistan and Sudan. Funds appropriated by this Act may be obligated and expended notwithstanding section 10 of Public Law 91-672 (22 U.S.C 2412), section 15 of the State Department Basic Authorities Act of 1956 (22 U.S.C. 2680) and section 504(a)(1) of the National Security Act of 1947 (50 U.S.C 414(a)(1)). The proposal contains appropriations for a number of items for which authorizations for fiscal year 2009 have not yet been enacted. This provision would allow funds appropriated to be obligated in the absence of a prior authorization of appropriations. BUYING POWER MAINTENANCE ACCOUNT Sec. 644. Buying Power Maintenance Account. Expired, unobligated balances of funds appropriated for fiscal year 2009 under the headings `Administration of Foreign Affairs' and 'Broadcasting Board of Governors' in this or any other Act may be transferred to and merged with the Buying Power Maintenance Accounts of the Department of State and the Broadcasting Board of Governors, respectively, not later than the end of the fifth fiscal year after the last fiscal year for which such funds are available for the purposes for which appropriated, notwithstanding section 24(b)(7)(D) of the State Department Basic Authorities Act. This provision would permit the transfer of expired, unobligated balances of funds appropriated for fiscal year 2009 to the no-year Buying Power Maintenance Accounts of the Department of State and Broadcasting Board of Governors (BBG). This authority will help the Department of State and Broadcasting Board of Governors offset adverse fluctuations in foreign currency exchange rates, which in recent years have exerted considerable downward pressure on Department of State and BBG accounts. The provision waives section 24(b)(7)(D) of the State Department Basic Authorities Act (22 U.S.C. 2696(b)(7)(D)), which makes such transfers subject to advance appropriations, to clarify that exercise of this authority does not require future appropriations. The Buying Power Maintenance Account (BPMA) authority was established to provide the Department of State and the Broadcasting Board of Governors with a mechanism to respond to varying exchange rates; however, both accounts have been depleted and are unable to capture exchange rate gains due to the dollar's prolonged decline overseas.
