   PROVIDING FOR CONSIDERATION OF THE BILL (H.R. 5658) TO AUTHORIZE 
  APPROPRIATIONS FOR FISCAL YEAR 2009 FOR MILITARY ACTIVITIES OF THE 
 DEPARTMENT OF DEFENSE, TO PRESCRIBE MILITARY PERSONNEL STRENGTHS FOR 
                FISCAL YEAR 2009, AND FOR OTHER PURPOSES

  Mr. Hastings of Florida, from the Committee on Rules, submitted the 
                               following

                              R E P O R T

                      [To accompany H. Res. 1213]

    The Committee on Rules, having had under consideration 
House Resolution 1213, by a non-record vote, report the same to 
the House with the recommendation that the resolution be 
adopted.

                SUMMARY OF PROVISIONS OF THE RESOLUTION

    The resolution provides for consideration of H.R. 5658, the 
``Duncan Hunter National Defense Authorization Act for Fiscal 
Year 2009.'' The resolution provides for two hours of general 
debate equally divided and controlled by the chairman and 
ranking minority member of the Committee on Armed Services.
    The resolution waives all points of order against 
consideration of the bill except those arising under clause 9 
or 10 of rule XXI. The resolution provides that the Committee 
of the Whole shall rise without motion after general debate. 
Finally, the resolution prohibits further consideration of the 
bill except pursuant to a subsequent order of the House.

                         EXPLANATION OF WAIVERS

    The waiver of all points of order against consideration of 
the bill (except those arising under clause 9 or 10 of rule 
XXI) includes waivers of: (1) clause 3(e) of rule XIII 
(indicating changes to existing law); (2) clause 4(a) of rule 
XIII (regarding three-day availability of the committee 
report); and (3) section 303 of the Congressional Budget Act 
(mistimed changes in direct spending).
